No. 4059 of 2007\n           ==========================\n         Dated this the 19th day of November, 2007\n\n                             O R D E R\n<\/pre>\n<p>      In this Revision filed under Section 397 read with Sec. 401<\/p>\n<p>Cr.P.C. the petitioner who was the accused in S.T. No.516 of<\/p>\n<p>2003 on the file of the Chief Judicial Magistrate Court,<\/p>\n<p>Pathanamthitta challenges      the conviction   entered and the<\/p>\n<p>sentence passed against      him for an offence punishable under<\/p>\n<p>Sec. 138 of the Negotiable Instruments Act, 1881 (hereinafter<\/p>\n<p>referred to as &#8216;the Act&#8217;).\n<\/p>\n<p>      2.   I heard the learned counsel for the Revision Petitioner<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>      3.   The learned counsel appearing for the Revision<\/p>\n<p>Petitioner re-iterated the contentions in support of the Revision.<\/p>\n<p>The courts below have concurrently held that the cheque in<\/p>\n<p>question was drawn by the petitioner           in favour of the<\/p>\n<p>complainant on the drawee bank, that the cheque was validly<\/p>\n<p>presented to the bank, that it was dishonoured for reasons which<\/p>\n<p>fall under Section 138 of the Act, that the complainant made a<\/p>\n<p>demand for payment by a notice in time in accordance with<\/p>\n<p>clause (b) of the proviso to Section 138 of the Act and that the<\/p>\n<p>Revision Petitioner\/accused failed to make the payment within<\/p>\n<p>15 days of receipt of the statutory notice.  Both the courts have<\/p>\n<p>considered and rejected the defence set up by the revision<\/p>\n<p><span class=\"hidden_text\">CRL.R.P. NO. 4059\/2007           : 2:<\/span><\/p>\n<p>petitioner while entering the above finding. The said finding has<\/p>\n<p>been recorded on an appreciation of the oral and documentary<\/p>\n<p>evidence. I do not find any error, illegality or impropriety in the<\/p>\n<p>finding so recorded concurrently by the courts below.          The<\/p>\n<p>conviction was thus rightly entered against the petitioner.<\/p>\n<p>      4.    What now survives for consideration is the question as<\/p>\n<p>to whether a proper sentence has been imposed on the Revision<\/p>\n<p>Petitioner. Having regard to the facts and circumstances of the<\/p>\n<p>case, I am, however, inclined to modify the sentence in the light<\/p>\n<p>of the recent pronouncement by the Supreme Court that no<\/p>\n<p>default sentence can be imposed for an order for compensation<\/p>\n<p>under Section 357(3) Cr.P.C.        The sentence imposed on the<\/p>\n<p>revision petitioner is set aside and instead he is sentenced to pay<\/p>\n<p>fine of Rs.4,88,000\/-(Rupees four lakhs and eighty eight<\/p>\n<p>thousand only) which shall be deposited within six months from<\/p>\n<p>today and on default to make the payment, he shall suffer simple<\/p>\n<p>imprisonment for three months. The fine amount shall be paid as<\/p>\n<p>compensation under Section 357(1) Cr.P.C.<\/p>\n<p>      This Revision is disposed of confirming the conviction but<\/p>\n<p>modifying the sentence as above.\n<\/p>\n<\/p>\n<p>                                       V.
