JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;A)\tadmit<br \/>\nthis petition;\n<\/p>\n<p>B)\tissue<br \/>\nappropriate writ, order or direction, directing the concerned<br \/>\nrespondent authorities for extending the benefit of sr. scale of<br \/>\nRs.3000-5000 to the petitioner w.e.f. 1.1.1996 i.e. the date on which<br \/>\nthe petitioner had completed 8 years service as Lecturer and also for<br \/>\nextending the benefit of corresponding revised pay-scale of<br \/>\nRs.10000-15200 w.e.f. 1.1.1996 i.e. the date on which the 5th<br \/>\nPay Commission came into force together with all consequential<br \/>\nbenefits flowing therefrom an appropriate directions be issued upon<br \/>\nthe concerned respondent authorities to fix the pension of the<br \/>\npetitioner accordingly in the aforesaid peculiar facts and<br \/>\ncircumstances of the case.\n<\/p>\n<p>C)\tpending<br \/>\nadmission and final disposal of the present petition, be pleased to<br \/>\nissue appropriate writ, order or direction, directing the concerned<br \/>\nrespondent authorities to consider the case of the petitioner for<br \/>\nextending the benefit of sr.scale of Rs.3000-5000 to the petitioner&#8217;s<br \/>\nhusband w.e.f. 1.1.1996 i.e. the date on which the petitioner had<br \/>\ncompleted 8 years service as Lecturer and also for extending the<br \/>\nbenefit of corresponding revised pay-scale of Rs.10000-15200 w.e.f.<br \/>\n1.1.1996 i.e. the date on which the 5th Pay Commission<br \/>\ncame into force together with all consequential benefits flowing<br \/>\ntherefrom and appropriate directions be issued upon the concerned<br \/>\nrespondent authorities to fix the pension of the petitioner<br \/>\naccordingly till the aforesaid petition is finally heard and decided.\n<\/p>\n<p>D)\tpass<br \/>\nsuch orders as thought fit in the interest of justice.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset, Mr. Sanjay Suthar, learned advocate for Mr. N.K.<br \/>\nMajmudar, learned counsel for the petitioner states that the interest<br \/>\nof justice would be met, if the petitioner is  permitted to make a<br \/>\nrepresentation to respondent No.2, within a period of two weeks from<br \/>\ntoday, directing the said respondent to consider and decide the same,<br \/>\nexpeditiously.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>(a)\tThe<br \/>\npetitioner is permitted to make a representation to respondent No.2,<br \/>\nwithin a period of two weeks from today.\n<\/p>\n<p>(b)\tIf<br \/>\nthe said representation is made within the stipulated period of time,<br \/>\nrespondent No.2 shall consider and decide the same, within a period<br \/>\nof three months from the date of receipt thereof, in accordance with<br \/>\nlaw.\n<\/p>\n<p>\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>4.\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>(Smt.\n<\/p>\n<p>Abhilasha Kumari, J.)<\/p>\n<p>Safir*\t<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Keshavlal vs State on 1 March, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
