Pravina Kumari, learned counsel for the<\/p>\n<p>                   petitioner, Sri Krishna Murari Prasad, learned AC to Government<\/p>\n<p>                   Advocate No. 6, appearing on behalf of Respondent Nos. 1, 2, 3, 5<\/p>\n<p>                   &amp; 6\/State of Bihar and Sri K.N. Choubey, learned counsel appearing<\/p>\n<p>                   on behalf of Respondent No. 4\/Accountant General, Bihar, Patna.<\/p>\n<p>                                Sri Krishna Murari Prasad, learned AC to Government<\/p>\n<p>                   Advocate No. 6, makes a prayer to adjourn the case for two weeks<\/p>\n<p>                   for filing counter affidavit.\n<\/p>\n<p>                                Learned counsel for the petitioner Smt. Pravina Kumari<\/p>\n<p>                   submits that for the relief sought for in the present writ petition the<\/p>\n<p>                   petitioner has already filed representation before the competent<\/p>\n<p>                   authority, and as such, instead of adjourning the case the writ<\/p>\n<p>                   petition may be disposed of directing the Respondents to take<\/p>\n<p>                   decision on the representation of the petitioner.<\/p>\n<p>                                In view of stand taken by the learned counsel for the<\/p>\n<p>                   petitioner, there is no need to adjourn the matter for filing counter<\/p>\n<p>                   affidavit.\n<\/p>\n<p><span class=\"hidden_text\">                           2<\/span><\/p>\n<p>                 The petitioner, who retired as &#8216;Assistant Engineer&#8217; from<\/p>\n<p> Irrigation Division No. 2, Lakshmipur Camp, Banka, which<\/p>\n<p> according to learned counsel for the petitioner, has merged with<\/p>\n<p> Irrigation Mechanical Division, Samastipur, has prayed for directing<\/p>\n<p> the Respondents to grant following reliefs:-<\/p>\n<p>               I) Difference of salary of post of Assistant Engineer from<\/p>\n<p>1.1.01 with interest.\n<\/p>\n<p>               II) Arrear of salary and arrear pension, gratuity, earn leave<\/p>\n<p>and pension fixation on the basis of 1 st and 2nd A.C.P. from 9.8.99<\/p>\n<p>with interest.\n<\/p>\n<p>               III) G.P.F. amount from Jan. 1973 to 82-83 with interest.<\/p>\n<p>               IV) And any other due if so any for which the petitioner<\/p>\n<p>is entitled.\n<\/p>\n<p>                 Learned counsel for the petitioner has drawn my<\/p>\n<p>attention to &#8216;Annexure-4 Series&#8217; to the writ petition which are<\/p>\n<p>different representations filed before the authority concerned<\/p>\n<p>including Respondent No. 2.\n<\/p>\n<p>                 In view of the stand taken by learned counsel for the<\/p>\n<p>petitioner, there is no need to keep the matter pending. The writ<\/p>\n<p>petition stands disposed of granting liberty to the petitioner to file a<\/p>\n<p>fresh detailed representation before Respondent No. 2\/Chief Engineer<\/p>\n<p>Mechanical Division, Water Resources Development Department,<\/p>\n<p>Bihar, Patna, for the reliefs claimed in the present writ petition within<\/p>\n<p>a period of six weeks from today. If such representation is filed,<\/p>\n<p>Respondent No. 2 is required to examine the same and pass<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>         appropriate order in accordance with law within a period of three<\/p>\n<p>         months from the date of filing of such representation. If Respondent<\/p>\n<p>         No. 2 considers the claim of the petitioner as genuine he is required<\/p>\n<p>         to pass order for clearing the dues within three months from the date<\/p>\n<p>         of filing of such representation.
