Justice PIUS C.KURIAKOSE\n\n Dated :12\/03\/2007\n\n O R D E R\n                            PIUS C.KURIAKOSE, J.\n\n                        ----------------------------------\n\n                        W.P.(C)NO. 5971  of    2007\n\n                        ----------------------------------\n\n                   Dated this 12th  day of   March, 2007\n\n\n                                    JUDGMENT\n<\/pre>\n<p>          The   grievance,   which   is   voiced   by   the   petitioner,   is   that<\/p>\n<p>though     construction   of   a     Tourist   Resort   by   name   Maria   Cliff<\/p>\n<p>Resorts   was   taken   up   by   him   on     2   Acres   and   25   cents   of<\/p>\n<p>property in Resurvey No.15. 165\/1-3 of Pallivasal Village on the<\/p>\n<p>basis of a no   objection certificate issued by the first respondent<\/p>\n<p>panchayat, respondents 2 and 4 viz. RDO and the Village Officer<\/p>\n<p>respectively   are   without   any   reasonable     cause   interfering   with<\/p>\n<p>the   construction   and       preventing   him   from   carrying   out   the<\/p>\n<p>construction. Even though more than one opportunity was given<\/p>\n<p>to   the   Government   Pleader   for   seeking   instruction   from<\/p>\n<p>respondents 2 and 3, she has not been able to get instructions so<\/p>\n<p>far.\n<\/p>\n<\/p>\n<p>          2.   Heard both sides.   Considered the documents placed on<\/p>\n<p>record by the petitioner.  I  do not find any reason presently as to<\/p>\n<p>why   respondents   2   and   4     should   interfere   in   the   matter   of<\/p>\n<p><span class=\"hidden_text\">WPC No. 5971\/2007                         2<\/span><\/p>\n<p>carrying out of the construction by the petitioner.<\/p>\n<p>         I   dispose   of   the   writ   petition   permitting   the   petitioner   to<\/p>\n<p>complete the construction of  the  Resort by name Maria Resort in<\/p>\n<p>the   property     which   is   subject   matter   of   this   writ   petition.<\/p>\n<p>However,   the   petitioner   will   be   informed   that   the   construction<\/p>\n<p>will be at his risk and will not stand in the way of the Government<\/p>\n<p>or   respondents   2   to   4       initiating   any   proceedings   in   future   on<\/p>\n<p>valid grounds.\n<\/p>\n<\/p>\n<p>                                                PIUS C.KURIAKOSE<\/p>\n<p>                                                             Judge<\/p>\n<p>dpk<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court John Michael vs The Pallivasal Grama Panchayat on 12 March, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 5971 of 2007(J) 1.
