                            Judgment<\/p>\n
Koshy,J.\n<\/p>\n
           Some of the teachers as well as the management<\/p>\n
approached this court as the appointment of the teachers were not<\/p>\n
approved from the date of their appointments and salary was not<\/p>\n
paid. On the basis of the contentions, files were called for and it<\/p>\n
was found that they were appointed in the sanctioned posts against<\/p>\n
existing vacancies.   It was also found that those teachers were<\/p>\n
academically fully qualified. These are all private aided colleges<\/p>\n
and appointments are to be made by the college management on<\/p>\n
the recommendation of a selection committee constituted as per<\/p>\n
Rules.  Contention of the university was that manager did not<\/p>\n
consider all the applications while selecting the teachers.     In<\/p>\n
paragraph 20 of the judgment, the learned single Judge considered<\/p>\n
the matter as follows:\n<\/p>\n
                  “20.  When the available vacancies are
\n           few, and the number of applicants is large, it is
\n           always open to the management to restrict the
\n           zone of consideration, subject to any minimum<\/p>\n

                prescribed in the rules.    If there is no such
\n                prescription, management need only ensure the
\n                availability of reasonable number of candidates
\n                as against the number of vacancies that are to
\n                be filled up following a reasonable criteria. This
\n                right of the management, to shortlist the
\n                candidates cannot be doubted, so long as the
\n                criteria adopted is fair and reasonable in the
\n                light of the judgments in Union of India and
\n                another v. T. Sundararaman and others ((1997)
\n                4 SCC 664), Madhya Pradesh Public Service
\n                Commission v. Navnit Kumar Potdar and<\/a> another
\n                ((1994) 6 SCC 293) and Jayakumar v. High Court
\n                of Kerala<\/a> (2001 (2) KLT 924).       Therefore, I
\n                cannot accept the plea of the University that the
\n                Management was incompetent to short list
\n                candidates. The further question is whether
\n                there was sufficient number of short listed
\n                candidates for selection.    University has not
\n                raised such an argument and therefore it is not
\n                necessary for me to consider that issue.”\n<\/p><\/blockquote>\n
The selection committee was constituted correctly and the<\/p>\n
contention that at least three persons should have been called for<\/p>\n
each post was also considered in paragraph 23 of the judgment as<\/p>\n
follows:\n<\/p>\n
                       “23. A reading of Statute 3 (1) shows that
\n                in order to ensure that appointment of teachers
\n                by direct recruitment are on the basis of merit,
\n                such appointments shall be made from a panel
\n                of three names for every vacancy recommended
\n                by a selection committee constituted in the
\n                manner provided therein.     However, statute 3
\n                (3) provides that notwithstanding statute 3 (1) in
\n                the case of an educational agency which has
\n                entered      into direct  payment     agreement,<\/p>\n

                appointment of teachers shall be made from a
\n                list   of   persons   prepared   by   a  selection
\n                committee constituted in the manner provided
\n                therein. Constitution of the Selection Committee
\n                in so far as per Statutes 3 (1) and 3 (3) are also
\n                different.      University has no case that the
\n                college has not entered into direct payment
\n                agreement.      If that be so, what is relevant is
\n                statute 3 (3) and unlike statute 3 (1), statute 3
\n                (3) does not prescribe the requirement of a
\n                panel of three names, but only provides that
\n                appointment of teachers shall be made only
\n                from a list of persons prepared by a selection
\n                committee.      Therefore, as far as the college is
\n                concerned, it is governed by statute 3 (3) and
\n                there is no requirement of a panel of three
\n                names for every vacancy.       I do not find any
\n                substance in the plea of the University that
\n                statute 3 (3) of Chapter 45B is subject to statute
\n                3 (1), since such an interpretation is against the
\n                plain terms of the statute itself. Hence, the 2nd
\n                reason       assigned    in   Ext.P16    is   also
\n                unacceptable.”\n<\/p><\/blockquote>\n
These two objections were raised by the University and they were<\/p>\n
found unsustainable by the Court. Individual cases were considered<\/p>\n
by the learned Judge in detail and allowed the writ petitions and<\/p>\n
directed the respondents in the writ petition to disburse their pay<\/p>\n
and allowances with full service benefits from the date of their due<\/p>\n
appointment.         Since teachers were selected by a duly appointed<\/p>\n
selection committee as per the Rules and they were fully qualified<\/p>\n
and appointments were made to the sanctioned vacancies, we fully<\/p>\n
W.A. Nos. 2204, 2219 & 2220\/2008    4<\/p>\n
agree with the views of the learned single Judge and since we fully<\/p>\n
agree with the views, we are not reiterating the views.    All the<\/p>\n
appeals are dismissed.\n<\/p>\n<\/p>\n
