Raval,<br \/>\nlearned APP waives service of notice of Rule on behalf of respondent<br \/>\nState. In the facts and circumstances of the case and with the<br \/>\nconsent of the learned advocates for the respective parties, the<br \/>\napplication is taken up for final hearing today.\n<\/p>\n<p>2.\tPresent<br \/>\napplication under Section 482 of the Code of Criminal Procedure has<br \/>\nbeen preferred by the petitioners-original accused to quash and set<br \/>\naside the impugned complaint\/FIR being CR. No.II-3039 of 2009<br \/>\nregistered with the Dhangadhra Police Station filed by respondent<br \/>\nno.2.\n<\/p>\n<p>3.\tShri<br \/>\nDagli, learned advocate for the petitioners no.1 to 4 and 7 does not<br \/>\npress present application. Hence, present application is dismissed as<br \/>\nwithdrawn so far as petitioner nos. 1 to 4 and 7 are concerned.<br \/>\nTherefore, this petition is required to be considered qua the<br \/>\npetitioner nos. 5 and 6 only.\n<\/p>\n<p>4.\tHeard<br \/>\nthe learned advocate for the petitioner nos. 5 and 6 and Ms. Mamta<br \/>\nVyas, learned advocate for the respondent no.2-original complainant<br \/>\nand considered the averments and allegations against the petitioner<br \/>\nnos. 5 and 6 in the complaint. Considering the facts and<br \/>\ncircumstances of the case and when petitioner nos. 5 and 6 were<br \/>\nresiding separately and there is a broad consensus between the<br \/>\nlearned advocates, let the impugned complaint \/ FIR be quashed and<br \/>\nset aside qua petitioner nos. 5 and 6 only and without prejudice to<br \/>\nthe rights rights and contentions of the respective parties qua other<br \/>\naccused persons. Learned advocates for the respective parties do not<br \/>\ninvite any further reasoned order while quashing and setting aside<br \/>\nthe impugned FIR so far as petitioner nos. 5 and 6 are concerned.<br \/>\nHence, this Court is not further assigning any reasoned order. Even<br \/>\notherwise, this Court is prima facie satisfied that there is no case<br \/>\nagainst petitioner nos. 5 and 6 for the offences punishable under<br \/>\nSections 323, 504, 506(2), 498(A) and 114 of of Indian Penal Code and<br \/>\nSection 3 and 4 of the Dowry Prohibition Act.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above and broad consensus between the parties the<br \/>\nimpugned complaint being CR. No.II-3039 of 2009 registered with the<br \/>\nDhangadhra Police Station lodged by respondent no.2 herein-original<br \/>\ncomplainant is hereby quashed and so far as petitioner nos. 5 and 6<br \/>\nonly. However, the same shall be without prejudice to the rights and<br \/>\ncontention of the respective parties qua other accused persons.
