The\u00a0Applicant\u00a0filed\u00a0his\u00a0RTI\u00a0application\u00a0 dt.8.9.09\u00a0with\u00a0the\u00a0CPIO,\u00a0ITDC\u00a0requesting\u00a0for\u00a0the\u00a0following\u00a0<\/p>\n<p>        information:\n<\/p>\n<p>        i)       List\u00a0of\u00a0employees\u00a0granted\u00a0special\u00a0increments<\/p>\n<p>        ii)      Criteria\u00a0taken\u00a0for\u00a0granting\u00a0the\u00a0special\u00a0increments<\/p>\n<p>        iii)     Copy \u00a0 of \u00a0 the \u00a0 approval \u00a0 taken \u00a0 from \u00a0 the \u00a0 appropriate \u00a0 authority \u00a0 for \u00a0 granting \u00a0 the \u00a0 special\u00a0<\/p>\n<p>        increments<\/p>\n<p>        iv)      Copy\u00a0 of \u00a0 the\u00a0 rule \u00a0 of \u00a0 corporation\u00a0 under\u00a0 which\u00a0 the\u00a0 special\u00a0 increments\u00a0 were\u00a0 granted.\u00a0 Shri\u00a0<\/p>\n<p>        S.K.Maitra,\u00a0Vice\u00a0Presidence\u00a0(HR\u00adCPIO)\u00a0replied\u00a0on\u00a030.9.09\u00a0informing\u00a0the\u00a0Applicant\u00a0that\u00a0information\u00a0<\/p>\n<p>        desired\u00a0is\u00a0denied\u00a0as\u00a0per\u00a0Section\u00a02(f)\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a02005\u00a0as\u00a0the\u00a0same\u00a0needs\u00a0compilation.\u00a0\u00a0Further,\u00a0<\/p>\n<p>        the\u00a0CPIO\u00a0is\u00a0not\u00a0expected\u00a0to\u00a0furnish\u00a0information\u00a0which\u00a0involves\u00a0compilation.\u00a0Not\u00a0satisfied\u00a0with\u00a0the\u00a0<\/p>\n<p>        reply,\u00a0the\u00a0Applicant\u00a0filed\u00a0an\u00a0appeal\u00a0dt.27.10.09\u00a0with\u00a0the\u00a0Appellate\u00a0Authority\u00a0stating\u00a0that\u00a0the\u00a0plea\u00a0taken\u00a0<\/p>\n<p>        by\u00a0the\u00a0CPIO\u00a0is\u00a0incorrect\u00a0as\u00a0the\u00a0information\u00a0does\u00a0not\u00a0need\u00a0any\u00a0compilation\u00a0and\u00a0is\u00a0well\u00a0covered\u00a0under\u00a0<\/p>\n<p>        the\u00a0definition\u00a0of\u00a0information\u00a0as\u00a0per\u00a0Section\u00a02(f)\u00a0of\u00a0the\u00a0Act\u00a0and\u00a0requested\u00a0the\u00a0Appellate\u00a0Authority\u00a0to\u00a0<\/p>\n<p>        direct\u00a0the\u00a0CPIO\u00a0to\u00a0provide\u00a0the\u00a0information\u00a0as\u00a0sought\u00a0by\u00a0him.\u00a0Shri\u00a0P.P.Singh,\u00a0Appellate\u00a0Authority\u00a0and\u00a0<\/p>\n<p>        Director\u00a0(F)\u00a0in\u00a0his\u00a0order\u00a0dt.26.11.09\u00a0stated\u00a0that\u00a0the\u00a0Applicant\u00a0in\u00a0his\u00a0RTI\u00a0application\u00a0has\u00a0not\u00a0specified\u00a0<\/p>\n<p>        the\u00a0period\u00a0for\u00a0which\u00a0the\u00a0information\u00a0is\u00a0required\u00a0by\u00a0him.\u00a0 \u00a0He,\u00a0however,\u00a0directed\u00a0the\u00a0CPIO\u00a0to\u00a0allow\u00a0<\/p>\n<p>        inspection\u00a0of\u00a0all\u00a0the\u00a0files\u00a0relating\u00a0to\u00a0the\u00a0information\u00a0as\u00a0requested\u00a0by\u00a0the\u00a0Applicant\u00a0and\u00a0also\u00a0to\u00a0provide\u00a0<\/p>\n<p>        him\u00a0with\u00a0copies\u00a0of\u00a0the\u00a0records\/documents.\u00a0He\u00a0further\u00a0added\u00a0that\u00a0the\u00a0Applicant\u00a0will\u00a0have\u00a0to\u00a0pay\u00a0the\u00a0<\/p>\n<p>        inspection\u00a0fee\u00a0as\u00a0prescribed\u00a0under\u00a0the\u00a0RTI\u00a0Act\u00a0and\u00a0rules\u00a0framed\u00a0there\u00a0under.\u00a0 \u00a0With\u00a0reference\u00a0to\u00a0<\/p>\n<p>        S.No.4\u00a0of\u00a0the\u00a0RTI\u00a0application,\u00a0he\u00a0directed\u00a0the\u00a0CPIO\u00a0to\u00a0provide\u00a0the\u00a0copy\u00a0of\u00a0the\u00a0relevant\u00a0rules\u00a0in\u00a0vogue\u00a0<\/p>\n<p>        in\u00a0ITDC\u00a0under\u00a0which\u00a0the\u00a0special\u00a0increments\u00a0are\u00a0granted\u00a0to\u00a0the\u00a0employees\u00a0of\u00a0ITDC.\u00a0In\u00a0compliance\u00a0to\u00a0<\/p>\n<p>        the\u00a0Appellate\u00a0Authority&#8217;s\u00a0order,\u00a0Shri\u00a0S.K.Maitra\u00a0vide\u00a0his\u00a0letters\u00a0dt.2.12.09\u00a0and\u00a014.12.09\u00a0invited\u00a0the\u00a0<\/p>\n<p>        Applicant\u00a0for\u00a0inspection\u00a0of\u00a0files\u00a0on\u00a09.12.09\u00a0and\u00a022.12.09\u00a0respectively.\u00a0Not\u00a0satisfied\u00a0with\u00a0the\u00a0reply,\u00a0the\u00a0<\/p>\n<p>        Applicant\u00a0filed\u00a0a\u00a0second\u00a0appeal\u00a0dt.18.12.09\u00a0before\u00a0CIC\u00a0stating\u00a0that\u00a0he\u00a0had\u00a0written\u00a0a\u00a0letter\u00a0dt.8.12.09\u00a0<\/p>\n<p>        requesting\u00a0the\u00a0CPIO\u00a0to\u00a0allow\u00a0him\u00a0to\u00a0inspect\u00a0the\u00a0files\u00a0and\u00a0to\u00a0provide\u00a0the\u00a0documents\u00a0free\u00a0of\u00a0charge\u00a0but\u00a0<br \/>\n          the\u00a0CPIO\u00a0failed\u00a0to\u00a0provide\u00a0the\u00a0information\u00a0within\u00a0one\u00a0month\u00a0of\u00a0filing\u00a0his\u00a0application\u00a0as\u00a0per\u00a0the\u00a0RTI\u00a0Act\u00a0<\/p>\n<p>         and\u00a0that\u00a0he\u00a0had\u00a0refused\u00a0to\u00a0provide\u00a0the\u00a0information\u00a0free\u00a0of\u00a0cost.<\/p>\n<p>2.       The\u00a0Bench\u00a0of\u00a0Mrs.\u00a0Annapurna\u00a0Dixit,\u00a0Information\u00a0Commissioner,\u00a0scheduled\u00a0the\u00a0hearing\u00a0for\u00a0April\u00a05,\u00a0<\/p>\n<p>         2010.\u00a0\u00a0\n<\/p>\n<\/p>\n<p>3.       Shri\u00a0Kashmiri\u00a0Lal,\u00a0Sr.Manager\u00a0(HR)\u00a0represented\u00a0the\u00a0Public\u00a0Authority.<\/p>\n<p>4.       The\u00a0Applicant\u00a0was\u00a0not\u00a0present\u00a0during\u00a0the\u00a0hearing.<\/p>\n<p>Decision<\/p>\n<p>5.       The\u00a0Respondents\u00a0produced\u00a0before\u00a0the\u00a0Commission\u00a0a\u00a0letter\u00a0dt.1.2.10\u00a0vide\u00a0which\u00a0 \u00a0information\u00a0was\u00a0<\/p>\n<p>         provided\u00a0to\u00a0the\u00a0Appellant,\u00a0free\u00a0of\u00a0cost.\u00a0\u00a0\n<\/p>\n<\/p>\n<p>6.       Since\u00a0there\u00a0is\u00a0no\u00a0further\u00a0communication\u00a0from\u00a0the\u00a0Appellant\u00a0after\u00a0he\u00a0received\u00a0the\u00a0information,\u00a0it\u00a0is\u00a0<\/p>\n<p>         assumed\u00a0that\u00a0he\u00a0is\u00a0satisfied\u00a0with\u00a0it.\u00a0\u00a0\n<\/p>\n<\/p>\n<p>7.       The\u00a0CPIO\u00a0to\u00a0showcause\u00a0as\u00a0to\u00a0why\u00a0a\u00a0penalty\u00a0of\u00a0Rs.\u00a0250\/\u00ad\u00a0per\u00a0day\u00a0should\u00a0not\u00a0be\u00a0imposed\u00a0upon\u00a0him\u00a0for\u00a0<\/p>\n<p>         not\u00a0providing\u00a0the\u00a0information\u00a0within\u00a0the\u00a0mandatory\u00a0period\u00a0of\u00a0one\u00a0month.\u00a0The\u00a0response\u00a0to\u00a0reach\u00a0the\u00a0<\/p>\n<p>         Commission\u00a0\u00a0by\u00a010\u00a0May,\u00a02010.\u00a0\n<\/p>\n<\/p>\n<p>8.
