Application No.11985 of 2010 was withdrawn.\n<\/p>\n<p>2.\tThe<br \/>\napplicant accused is charged with having committed offence under<br \/>\nSections 397, 395, 332, 427, 323, 504 &amp; 506(2) of IPC and under<br \/>\nSection 3(1)(c) of Prevention of Damages to Public Property Act, 1984<br \/>\nand Sec. 135 of Bombay Police Act for which FIR being C.R.No.<br \/>\nI-41\/2010 has been registered with Bhanwad Police\t Station.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel Mr. Kamal Sojitra submitted that considering the nature of<br \/>\noffence and the manner in which it is alleged to have been committed,<br \/>\npresent application may be allowed as now the charge-sheet has been<br \/>\nfiled. He has also submitted that as stated in the FIR itself, there<br \/>\nwas some gambling and when victim police personnel went there, the<br \/>\nincident has occurred. He, therefore, submitted that present<br \/>\napplication may be allowed.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Mr. Kartik Pandya resisted the application and submitted that<br \/>\nwhen the police personnel tried to prevent the gambling, the accused<br \/>\nattacked.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned Advocate Mr. Sojitra for the applicant and learned<br \/>\nAPP Mr. Kartik Pandya and having considered the nature of offence and<br \/>\nthe role attributed and also the fact that the charge-sheet has been<br \/>\nfiled, present application deserves to be allowed subject to the<br \/>\nconditions hereinafter.\n<\/p>\n<p>\t6.\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with the F.I.R. being C.R.No.<br \/>\n\tI-41\/2010 registered with Bhanwad Police Station, on his executing a<br \/>\n\tbond of Rs.5,000\/- (Rupees Five Thousand) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate with the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month of English calender between 11:00 AM to 2:00 PM till<br \/>\nthe trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>7.\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be  free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\n\tis made absolute to the aforesaid   extent.
