No. 2936 OF 2009\n                         --------------------------\n              Dated this the 24th day of March, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>      The appellant was the seventh respondent in the Writ Petition.<\/p>\n<p>The first respondent herein was the writ petitioner. The point that<\/p>\n<p>arises for decision in this case is whether the appointment of the<\/p>\n<p>sixth respondent Smt. N.Y.Ammini as Headmistress of a Lower<\/p>\n<p>Primary School, overlooking the claim of the appellant herein was<\/p>\n<p>valid for the reason that the first respondent did not follow a fair<\/p>\n<p>procedure as directed by this Court in <a href=\"\/doc\/1406607\/\">Kurian Lizy v. State of<\/p>\n<p>Kerala<\/a> (2006 (4) KLT 264 (F.B). The brief facts of the case are the<\/p>\n<p>following:\n<\/p>\n<p>      2.  The first respondent manages a few schools, including<\/p>\n<p>St.George L.P. School, Palode. It is not disputed before us that the<\/p>\n<p>said educational agency belongs to a minority community and<\/p>\n<p>therefore, is entitled to the protection of Article 30(1) of the<\/p>\n<p>Constitution of India. A vacancy in the post of Headmaster arose in<\/p>\n<p>St.George L.P.School, Palode on 1.4.2004.            The management<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>appointed Smt. N.Y.Ammini, who is admittedly junior to the appellant<\/p>\n<p>in the cadre of LPSA\/UPSA. The management asserted their rights<\/p>\n<p>under Article 30(1) of the Constitution of India in making their<\/p>\n<p>choice.     But, the motion made before the Assistant Educational<\/p>\n<p>Officer (AEO) for approval of the said appointment met with rejection,<\/p>\n<p>as evident from Ext.P2 communication of the AEO, Palode dated<\/p>\n<p>6.8.2004. The Manager appealed. The appeal was dismissed by the<\/p>\n<p>District Educational Officer (DEO) by Ext.P3 order dated 27.5.2005.<\/p>\n<p>AEO and DEO took the view that the appointment cannot be<\/p>\n<p>approved for the reason of overlooking the claim of the appellant,<\/p>\n<p>who is a senior. The Manager preferred Ext.P4 revision before the<\/p>\n<p>Director of Public Instruction (DPI). The said revision was dismissed<\/p>\n<p>by Ext.P5 order dated 21.3.2006, on the ground that the<\/p>\n<p>management did not produce any material to show they have the<\/p>\n<p>protection of Article 30(1) of the Constitution of India.        The<\/p>\n<p>management      filed  Ext.P6   revision  before   the   Government,<\/p>\n<p>challenging Ext.P5. The Government disposed of the revision by<\/p>\n<p>Ext.P7 order dated 11.3.2008.        The Government held that the<\/p>\n<p>management belongs to a minority community having the protection<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>of Article 30(1) of the Constitution of India. But, it was held by the<\/p>\n<p>Government that for not following the dictum laid down in Kurian<\/p>\n<p>Lizy (supra) the appointment is vitiated. Normally, the Government<\/p>\n<p>should have remitted the matter, directing the management to take a<\/p>\n<p>fresh decision in accordance with Kurian Lizy (supra). Instead of<\/p>\n<p>doing that, the Government ordered to appoint the appellant as<\/p>\n<p>Headmistress of the school. Challenging the said decision, Ext.P7 of<\/p>\n<p>the Government as also Exts.P2, P3 and P5, the Writ Petition was<\/p>\n<p>filed by the first respondent.\n<\/p>\n<p>      3.   The learned Single Judge allowed the Writ Petition, by<\/p>\n<p>quashing the impugned orders. The learned Judge noticed that in<\/p>\n<p>Manager, S.S.H.S. School v. Lijin (2007 (3) KLT 663) a Division<\/p>\n<p>Bench of this Court observed that Kurian Lizy (supra) is no longer<\/p>\n<p>good law in view of the decision of the Apex Court in <a href=\"\/doc\/81469\/\">Secy.<\/p>\n<p>Malankara Syrian Catholic College v. T.Jose &amp; Others<\/a> (2007(1)<\/p>\n<p>SCC 386). So, it was held that for not following the dictum laid down<\/p>\n<p>in    Kurian Lizy (supra) interference with the action of the<\/p>\n<p>management could not have been made. In that view of the matter,<\/p>\n<p>the impugned orders were quashed and the AEO was directed to<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                        4<\/span><\/p>\n<p>approve the appointment of Smt. N.Y.Ammini as Headmistress.<\/p>\n<p>When the Writ Appeal came up for hearing, the Division Bench took<\/p>\n<p>the view that the observation in Manager, S.S.H.S. School v. Lijin<\/p>\n<p>(supra) that Kurian Lizy (supra) is overruled by <a href=\"\/doc\/81469\/\">Secy. Malankara<\/p>\n<p>Syrian Catholic College v. T.Jose<\/a> (supra) is not correct. Therefore,<\/p>\n<p>the matter was referred to the Full Bench to consider the said point.<\/p>\n<p>The Full Bench answered the reference by order dated 18.3.2010 in<\/p>\n<p>the following manner:\n<\/p>\n<blockquote><p>       &#8220;In the result, we answer the reference, stating that the direction in<br \/>\n       Kurian Lizy (supra), to follow a fair procedure for overlooking the<br \/>\n       seniors and appointing a junior, is not impliedly overruled by<br \/>\n       Malankara Syrian Catholic College (Supra).         The Writ Appeal<br \/>\n       may be posted for hearing before the appropriate Bench, as per the<br \/>\n       roster.&#8221;<\/p><\/blockquote>\n<p>      In view of the above order of the Full Bench, the Writ Appeal<\/p>\n<p>was listed before us for final hearing.\n<\/p>\n<p>      4.    Sri. V.A.Muhammed, learned counsel appearing for the<\/p>\n<p>appellant submitted that though the directions in Kurian Lizy (Supra)<\/p>\n<p>were issued subsequently, the managements of private educational<\/p>\n<p>institutions always have a duty to follow a fair procedure in selecting<\/p>\n<p>the Headmaster. In T.M.A.Pai Foundation v. State of Karnataka<\/p>\n<p>(2002 (8) SCC 481), the Apex Court reminded about the duty of the<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                   5<\/span><\/p>\n<p>minority educational institutions in this regard. The learned counsel<\/p>\n<p>further pointed out that the appellant has been found unsuitable,<\/p>\n<p>relying on Exts.P8 and P10.        They are cooked up only for the<\/p>\n<p>purpose of this case. Ext.P10 is a document which is purportedly<\/p>\n<p>written long after the supersession of the appellant on 1.4.2004. So,<\/p>\n<p>the supersession has been made in an arbitrary and irrational<\/p>\n<p>manner. Further, the management did not have a case before the<\/p>\n<p>statutory authorities that the appellant was an unsuitable hand and<\/p>\n<p>was, therefore, superseded.\n<\/p>\n<p>      5. Sri. George Mecheril, learned counsel appearing for the first<\/p>\n<p>respondent submitted that the direction in Kurian Lizy (supra)<\/p>\n<p>concerning selection of Headmaster in minority educational<\/p>\n<p>institutions is unsustainable in law, as the same cannot stand with<\/p>\n<p>the absolute right of the minority educational institution under Article<\/p>\n<p>30(1) of the Constitution of India, to appoint persons of its choice as<\/p>\n<p>Headmaster\/Principal. In fact, while issuing the above directions in<\/p>\n<p>Kurian Lizy (supra), the Full Bench went beyond the reference made<\/p>\n<p>to it and therefore, the directions issued are not legally sustainable.<\/p>\n<p>The learned counsel also submitted that in the case on hand, the<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                    6<\/span><\/p>\n<p>vacancy arose on 1.4.2004 and therefore, the directions issued in<\/p>\n<p>Kurian Lizy (supra) on 16.8.2006 could not apply to the selection<\/p>\n<p>made on the 1.4.2004. Therefore, the view taken by the Government<\/p>\n<p>that the selection is bad for not complying with the directions issued<\/p>\n<p>after two years in Kurian Lizy (supra) is unsustainable in law.<\/p>\n<p>      6. Finally, it is pointed out that, the appellant is an unsuitable<\/p>\n<p>person and that will be evident from Ext.P8 communication of the<\/p>\n<p>Headmistress of the school. Ext.P9 is a communication issued by<\/p>\n<p>the AEO on a representation made by the appellant seeking<\/p>\n<p>permission to come late to the school. The learned counsel also<\/p>\n<p>relied on Ext.P10, which is a petition filed by the Headmaster of<\/p>\n<p>S.H.U.P. School, Chullimanoor before the first respondent pointing<\/p>\n<p>out the indisciplined conduct of the appellant. The learned counsel<\/p>\n<p>also took us through the pleadings of the first respondent on above<\/p>\n<p>aspect in para 5 and also Ground B of the Writ Petition. Therefore, it<\/p>\n<p>is pointed out that the appellant has been       superseded for valid<\/p>\n<p>reasons. So, the learned counsel prayed for dismissing the appeal.<\/p>\n<p>      7. We also heard the learned senior Government Pleader Sri.<\/p>\n<p>Benny Gervasis, who appeared for the official respondents.          The<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                       7<\/span><\/p>\n<p>learned Senior Government Pleader supported the impugned orders<\/p>\n<p>of the Government and other statutory authorities.<\/p>\n<p>      8.   The direction issued by the Full Bench of this Court in<\/p>\n<p>Kurian Lizy (supra) reads as follows:\n<\/p>\n<blockquote><p>       &#8220;After answer to the question directly covering the issue in hand<br \/>\n       with regard to appointment of Headmaster or Principal, nothing<br \/>\n       else survives for determination. It would be unnecessary in this<br \/>\n       order in probing further the matter.     We, thus, hold that the<br \/>\n       management of a minority educational institution would have<br \/>\n       freedom to appoint Headmaster or Principal. R.44(1) of the Rules<br \/>\n       of 1959 would have no control over the powers conferred under<br \/>\n       Art.30(1) of the Constitution, although such institution has<br \/>\n       necessarily to evolve a rationale procedure for selection of the<br \/>\n       Headmaster or Principal, this context, we feel that some directions<br \/>\n       should be issued to the Managements of minority educational<br \/>\n       institutions, to evolve a procedure for selection to the post of<br \/>\n       Headmaster, in the light of the observations in the answer to<br \/>\n       question 5(c) in T.M.A.Pai Foundation&#8217;s case (supra) quoted<br \/>\n       above. We notice that in many cases senior teachers belonging<br \/>\n       to the minority community, which runs the institution are<br \/>\n       superseded without assigning any reason.          Art.30(1) of the<br \/>\n       Constitution of India is an armour to protect the minority against<br \/>\n       the legislative and executive actions of the State, which is<br \/>\n       normally controlled by the majority. The said armour cannot be<br \/>\n       used as a weapon against other members of the same minority<br \/>\n       community.     The protection   under Art.30(1) is to the minority<br \/>\n       community and for the minority community. The Manager may<br \/>\n       supersede the members of other communities and also members<br \/>\n       of the minority community, who are found unsuitable for promotion<br \/>\n       to the post of Headmaster. But there may be teachers, who are,<br \/>\n       in every respect, qualified and suitable to head a minority<br \/>\n       educational institution.  The management may select the best<br \/>\n       among them. The selection procedure should be fair, reasonable<br \/>\n       and transparent. The eligible members of the minority community<br \/>\n       may not have a feeling that they have been superseded without<br \/>\n       any valid grounds. So, all minority educational institutions, which<br \/>\n       propose     to  select   the  best   person     to  the   post   of<br \/>\n       Headmaster\/Principal of a School or College, as the case may be,<br \/>\n       ignoring seniority in the feeder category or ignoring the available<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                       8<\/span><\/p>\n<p>        teachers, should frame and publish regulations or bye-laws,<br \/>\n        containing a transparent procedure, governing such selection.<br \/>\n        The publication can be made in the Notice Board of the<br \/>\n        educational institution concerned and a copy of it should be<br \/>\n        available in  school\/college library for reference.        When<br \/>\n        superseding a senior qualified member of the minority community<br \/>\n        the reasons thereof should be clear from the record. The question<br \/>\n        as framed in the beginning of this order is thus answered<br \/>\n        accordingly.&#8221;<\/p><\/blockquote>\n<p>      9. We are bound by the decision in Kurian Lizy (supra). It is a<\/p>\n<p>Full Bench decision. So, we cannot go into the contentions raised by<\/p>\n<p>the learned counsel for the management against the correctness of<\/p>\n<p>the decision in Kurian Lizy (supra). In view of the finding of the Full<\/p>\n<p>Bench that Kurian Lizy (supra) is not impliedly overruled by<\/p>\n<p>Malankara Syrian Catholic College (supra), all minority institutions<\/p>\n<p>are bound to follow the directions issued in Kurian Lizy (supra),<\/p>\n<p>concerning selection of Headmaster\/Principal in minority educational<\/p>\n<p>institutions, especially when, they propose to deviate from the<\/p>\n<p>seniority rule. In this case, we notice that the Government interfered<\/p>\n<p>with the selection of Smt. N.Y.Ammini only for the reason that the<\/p>\n<p>management did not follow the procedure as directed by this Court in<\/p>\n<p>Kurian Lizy (supra).         But, as rightly pointed out by the learned<\/p>\n<p>counsel for the first respondent, the decision to supersede the<\/p>\n<p>appellant was taken on 1.4.2004.           While taking that decision, the<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                  9<\/span><\/p>\n<p>management cannot follow the decision of the Full Bench of this<\/p>\n<p>Court, which was rendered in August 2006. So, the interference<\/p>\n<p>made by the Government with the decision of the management on<\/p>\n<p>that ground is unsustainable in law.\n<\/p>\n<p>      10. The next point to be considered is whether the decision of<\/p>\n<p>the Government could be sustained on other grounds. According to<\/p>\n<p>the management, the appellant is an unsuitable hand. According to<\/p>\n<p>the learned counsel for the appellant, the management did not have<\/p>\n<p>such a case, except before this Court. But for Kurian Lizy (supra),<\/p>\n<p>the right of the management to appoint any teacher of their choice,<\/p>\n<p>who is having the prescribed qualifications, as Headmaster is<\/p>\n<p>unfettered.    Relying on this well-settled legal position, the<\/p>\n<p>management defended the case before the statutory authorities and<\/p>\n<p>the Government. But, ultimately when they were defeated before the<\/p>\n<p>Government, the Writ Petition was filed.     They were, therefore,<\/p>\n<p>constrained to give the reasons for superseding the appellant. The<\/p>\n<p>appellant seriously disputes the reasons given by the management.<\/p>\n<p>But, we cannot under Article 226 of the Constitution of India sit in<\/p>\n<p>appeal over that dispute. The same being a disputed question, the<\/p>\n<p>W.A..No.2936\/09<br \/>\n<span class=\"hidden_text\">                                 10<\/span><\/p>\n<p>same will go against the appellant. In other words, based on the<\/p>\n<p>dispute raised by the appellant, we cannot interfere with the decision<\/p>\n<p>of the management on the choice of Headmaster, when they say that<\/p>\n<p>the person superseded is unsuitable.\n<\/p>\n<p>      In the result, we sustain the decision of the learned Single<\/p>\n<p>Judge though on a different ground. We hold that the directions in<\/p>\n<p>Kurian Lizy (supra) have no application to the present case and no<\/p>\n<p>valid grounds are available for interfering with the choice of the<\/p>\n<p>management of Smt. N.Y.Ammini, as Headmistress of St.George<\/p>\n<p>L.P.School, Palode.
