This appeal coming on for hearing this<\/p>\n
court delivered the following :\n<\/p>\n
J U D G M   <\/p>\n
This second appeal is <\/p>\n
his suit for mandatory injtiVi’1etion
\nprohibitory injunot,iVon_.folloWing’the._riisniis’sa1″of t.he suit.
\n\ufb01led by him and   concurring
\nwith the  his appeal. The<\/p>\n
concurreint.  form the backdrop for<\/p>\n
filin\u00e9ithis’  l ‘l\n<\/p>\n
2.  that. the plaintiff \ufb01led the suit<\/p>\n
 the nreliefof mandatory injunction directing the<\/p>\n
‘ torespondentlidefendant, herein to remove the lavatory pipe<\/p>\n
“af1’iXed’ lathe suit. property and also to remove the<\/p>\n
unauthorised Construction put up towards the west of<\/p>\n
A   plaintiffs house and to prevent the respondent-<\/p>\n
lgdefendant by an order of prohibitory injunction from<\/p>\n
obstruction the plaintiff in any manner. The said relief<\/p>\n
\/”\n<\/p>\n

of the plaintiff was based on the footing that the plaintiff
\nis the owner of the suit schedule property measuring<\/p>\n
east–West 25 feet and north\u00ab–south 42 feet  “$fa.sV’vthe<\/p>\n
ease of the plaintiff that he had put up <\/p>\n
measuring east–west 22 ft. anidf\ufb02nortth  :fi;~_:} rfhe ff’<\/p>\n

which exists to the west  suit
\nto construct a building -Lise the plaintiffs
\nsuit schedule property set back of

3 The stand of the’ defendant was that he had put<\/p>\n
up-ithef’eopnstructionin the property that belonged to him<\/p>\n
‘ stand?  ;dejfendant’s property measures 25 ft. X 60 ft.<\/p>\n
 the’.’~V’s_uVi’tVVschedule property does not belong to the<\/p>\n
plalililtlifff and, therefore, the suit of the plaintiff be<\/p>\n
A  dismissed. The defendant, therefore. took up the stand<\/p>\n

4. The aforesaid pleadings of the parties <\/p>\n

constructed the house on. the western theft-tuit..p<\/p>\n
property without leaving  set  issue<\/p>\n
was answered in l”..l:jIoweV\\Vrer’,f the other
\nissues-2, 3 and 4 were the plaintiff and<\/p>\n
finally’  =th”e.’.Vpi.aintiffw\u00a3as dismissed. The lower
\nappellatlel with the trial court and the
\nplaintiffs”~appeal._was ‘dismissed.<\/p>\n
5;!  cou’rt;~-wl*1i1e admitting this appeal, raised the<\/p>\n
V =foi’lowingisulostantial question of law:<\/p>\n
v’f’:VVi1et.her the courts below were justified in
\nH g\ufb01\u00e9futing to grant a decree for injunction and
\nmandatory injunction after holding that
\nplaintiff is the owner of the suit schedule<\/p>\n
properties and the defendant has put up<\/p>\n

construction on his entire property and the
\nstair case and other constructions are now
\nbeing put up in the one and a half space left.\u00bb
\nby the plaintiff, which is evidenced <\/p>\n

Murthy and perused the  of this case.\n<\/p>\n
7. The submission ‘of. counsel is that<\/p>\n
the courts below eI’i.’ed”in; n’ot.V:’notici:ig”the fact that the<\/p>\n
fl1ad..V.:clearlv’Vestablished before the trial
\n that his property measured<\/p>\n
25_ft,. X    western side, the plaintiff had<\/p>\n
-‘ v  pl\u00e9\ufb01istiifficient spaceas set back and had not put up the<\/p>\n
   the western side and taking advantage of<\/p>\n
this, V_the_defendant had encroached into the plaintiffs<\/p>\n
 is suit. ‘property. It is also submitted that towards the<\/p>\n
if ‘gfeastern side, the plaintiff had encroached 13\/2 ft. of the<\/p>\n
—–land belonging to the Municipality but, that does not<\/p>\n
give the defendant right to trespass into the plaintiffs<\/p>\n

land on the western side. Referring to the evidence of
\nP.W. 1 and D.W.1 and also to the sale deeds Exs._I?51 and<\/p>\n
13-5, it is argued that both the courts were in<\/p>\n
not appreciating the evidence from proper’* pp<\/p>\n
and the findings recorded loy'””‘th..e  f j <\/p>\n
contrary to the evidence on record-.and also’~contr’ar._v”to<\/p>\n
the Commissioner’s report,’ court,’ ‘in
\nhas to interfere by s–ettingg..a’si’dte  said\ufb01ndivngs of the
\ntrial court as affirmed  tl?1~eVulowe;r”appellate court.<\/p>\n
8. On theother  of the learned<\/p>\n
coun.\u00ab3el=for:”the:’:resp’ondent “isvvti’iat, both the courts have
\ntaken’-int\u00e9o  of the parties and the<\/p>\n
documents  regard was also had to the<\/p>\n
 re\u00a7p’ort..tg:of..v_theCommissioner and, on going through the<\/p>\n
  V”Co’mn1.i’ssione1j’s report, it can very Well be inferred that<\/p>\n
 plainfttffiizhas put up the construction exceeding the<\/p>\n
 actual _\u00b0measurement of the plaintiffs site on east–west<\/p>\n
 Vdirfection. By submitting that the measurement of the<\/p>\n
  _3east–west side of the plaintiffs property is 25 ft., it is<\/p>\n
argued that the Commissioner’s report revealed that the<\/p>\n
plaintiff had put up the house on the east-west side and
\nthe measurement is 26 ft. and ll inches and this itself<\/p>\n
shows that the plaintiff had exceeded the aetuatarea<\/p>\n
that belong to him even as per sale deed ‘_<\/p>\n
such, no error can be found i~n””‘the v_–‘:_ew,.t’al<eni  the f 5'<\/p>\n
courts below and particular reference vvas._tmade" <\/p>\n
learned counsel for the re's.pondent\u00ab.to  of
\nthe trial court's judgrnent." iiisu\ufb01ch,  submission
\nmade is that the  no substantial<\/p>\n
question of :law_ is also involvedv in appeal.<\/p>\n
9. .\u00bbHav.in”:V thus heard ‘the-v’learned counsel for the
\n2;; _ _
\nartie-s, the substantial. uestion of law raised, therefore,
\nP . . . V , .. F1,<\/p>\n
requires to be Van_swere–d at this juncture.<\/p>\n
   is noti’i’n~’disp’ute that the plaintiffs property<\/p>\n
5  rrieasures 25 ft. X 42 ft. even as per the sale<\/p>\n
deed  1}. It is the specific case of the plaintiff that<\/p>\n
 his “property measures 25 ft. east–West and 831’\/2 ft.<\/p>\n
 ‘V:1ojrth–south. The said property was divided equally<\/p>\n
it ibetween the plaintiff and his brother and, therefore,<\/p>\n
what fell to the share of the plaintiff was 25 ft. east–west<\/p>\n
2??\n<\/p>\n
and 42 ft. north~south. On this, there is no
\ndisagreement between the parties. Likewise, the<\/p>\n
property of the defendant measures 25 ft. X 6Gjfti”a.lso<\/p>\n
evidenced by document EX.D–5 sale l ‘_<\/p>\n
defendant. The plaintiff has ap’p1″oach’_edd_.ths. Tcovurtd ‘ j n<\/p>\n
for the relief of mandatory inj7u.n:c–tion <\/p>\n
injunction by contendingijdpidthat  the  had
\nencroached upon the plaintiffsiatdea. on thewestern side.
\nIt is, therefore,  the plaintiff to
\nestablish  the houses of the<\/p>\n
parties a5’:tu:al1_y”  .. to if plaintiff.<\/p>\n
ll.   ‘admitted facts in view, if one
\nlooks atithev eyideiicegfilaced before the trial court and<\/p>\n
  the CAommis’sioner’s report, the following picture<\/p>\n
V  .l:n’–the Commissioners report, 2 ft. 10 inches<\/p>\n
dopendspace is indicated as being in existence between<\/p>\n
 the *pr(:perty of the plaintiff and that of the defendant.<\/p>\n
  specific case of the plaintiff is that, he is the owner<\/p>\n
__5of the property measuring 25 ft. X 42 ft. Therefore, the<\/p>\n
plaintiff has put up the house in the aforesaid area.<\/p>\n
Then, including the set back area. the whole of the<\/p>\n
property of the plaintiff cannot exceed 25 ft. X 42 _ft_._<\/p>\n
12. The report of the Commissioner <\/p>\n
considered by both the courts. It is <\/p>\n
learned trial judge, referring:-\u00a5to’—-the7_4 <\/p>\n
report, has opined that the;_’m-ealsurernent: <\/p>\n
plaintiffs house including thehompoL1ndV..v\\}’alll”ilsl\ufb02beltweenV<\/p>\n
26 ft. 7 inches to 26*ft_. 11; the eastaavest side.
\nNo doubt, the plaintiff by stating<\/p>\n
that on the. ea.s:t.ern::__sidef  has encroached<\/p>\n
the pii’0p\u00bb-91l’:tlyT5 ‘1Vlu\u00abnieip’aiit3} by about 11\/2 ft. The
\n reveals that the defendants<\/p>\n
house onthev eat:vs}est’~.slide measures 24.9 ft. i.e., within<\/p>\n
  Thuslllin–sef’ar as 2 ft. 10 inches space lying<\/p>\n
  houses of the plaintiff and the defendant is<\/p>\n
lcohnlcernedg “the trial court took the View that the<\/p>\n
 Comi,nissioner’s report does not throw light on that<\/p>\n
V’ ‘ —  aspect.\n<\/p>\n
‘E13. The lower appellate court also considered the<\/p>\n
above material and has observed in the course of its<\/p>\n
%<\/p>\n
IO<\/p>\n
reasoning at paragraphs–12 and 13 that, when the
\nmeasurement of the plaintiffs house on east-west<\/p>\n
direction is found to be 22 ft. and includifng\ufb02he<\/p>\n
compound wall to be 26 ft. 7 inches, the lovverli<\/p>\n
court, therefore, concluded th.at~ the   <\/p>\n
plaintiff that the defendant   <\/p>\n
plaintiffs land on the western side c__annot: !5~e”‘aec’epted’.’ V<\/p>\n
The learned judge ofthe l.ow’e.r:’appel1atecourt has also
\nobserved that even iflllthell that he had
\nencroached.  foot\u00bb   “Vjbdelonging to the<\/p>\n
  the\u00bb–compound wall on the<\/p>\n
eastern_sidefhas.to\u00ab..l5e___ar:cepted, yet, even after giving
\nailowance for ‘the~ psaiud—. encroachment, the measurement<\/p>\n
of i.plaintiff_Vs lproperty on the east–west side will have<\/p>\n
  25 ft. But, the Commissioners report is to<\/p>\n
  it puts the measurement from east-\n<\/p>\n
  ft. 17 inches. It is on the aforesaid<\/p>\n
” consideration of the evidence on record and the<\/p>\n
2′-:Cornmissioner’s report that the learned judge of the<\/p>\n
H lower appellate court found that the Commissioners<\/p>\n
report has not done any good to help the case of the<\/p>\n
2\u00bb<\/p>\n
,4<\/p>\n
plaintiff but, on the other hand, the material on record
\nleads to the conclusion that the plaintiff has faiied to
\nestablish that 11\/2 ft. space on the western <\/p>\n
plaintiffs property belongs to the plaintiff.  ,  V’  <\/p>\n
14. In the light of the aforesaid.  of the 91′ <\/p>\n
evidence on record. the View tai~:er1*_by the co\u00bbu.rts\u00bb.be1Vowu<\/p>\n
cannot be termed as perver’s:ep”nor canit  that the
\nCommissioner’s   theficalse of the
\nplaintiff but, on they’x\ufb01if3e’_’..Commissioners
\nreport itself”l:h,as  the plaintiffs<\/p>\n
contention reg’a,rds7.’:Vth’e–open’space on the western<\/p>\n
side beiiig  property.\n<\/p>\n
 ” In the, of the aforesaid discussion, the<\/p>\n
V’ ws_ubstantial,_ question of law is answered in favour of the<\/p>\n
 ._VliefW the courts below and the Commissioners<\/p>\n
re’porvt:has also led to the aforesaid View being taken by<\/p>\n
V * the courts below and, as such, I see no perversity of<\/p>\n
 recorded by the trial court. The appeal,<\/p>\n
H therefore, lacks merit\ufb01i is dismissed.<\/p>\n
‘;\n<\/p>\n
The dismissal of this appeal, however, shall not
\ncome in the way of the plaintiff establishing his V’–t”.e over<\/p>\n
the open space and in such an event, the<\/p>\n
observations shall not come in the way   <\/p>\n
