Srivastava.\n\n                                        -----------\n<\/pre>\n<p>5   30.9.2010                  Heard learned counsel for the appellants and<\/p>\n<p>                 learned counsel for the respondents.<\/p>\n<p>                               We were taken through the Division Bench<\/p>\n<p>                 Judgment of this court in CWJC No.6298 of 1988 passed on<\/p>\n<p>                 05.04.1989. That judgment was followed in another writ<\/p>\n<p>                 petition bearing CWJC No.5826 of 1988 which was disposed<\/p>\n<p>                 of on 26.02.1990. The writ petitioner has claimed to be a co-<\/p>\n<p>                 petitioner in CWJC No.5826 of 1988 which was filed on<\/p>\n<p>                 behalf of the association. The issue settled by those two<\/p>\n<p>                 judgments of the Division Bench is to the effect that<\/p>\n<p>                 petitioner and similarly situated employees continued to be<\/p>\n<p>                 employees of the Minor Irrigation Department and were<\/p>\n<p>                 rightly granted time bound promotion by the said<\/p>\n<p>                 Department. Cancellation of time bound promotions through<\/p>\n<p>                 orders dated 7.6.1988 and 5.8.1988 on the ground that<\/p>\n<p>                 petitioner and similarly situated employees had become<br \/>\n<span class=\"hidden_text\">                        -3-<\/span><\/p>\n<p>        employees of the Finance Department was not accepted by<\/p>\n<p>        the Division Bench till the year 1989-90.<\/p>\n<p>                       The State accepted those decisions and<\/p>\n<p>        thereafter there is no further material to hold that the position<\/p>\n<p>        changed making the writ petitioner employee of the Finance<\/p>\n<p>        Department.\n<\/p>\n<p>                       Learned writ Court has considered all the<\/p>\n<p>        relevant facts and has rightly relied upon the aforesaid two<\/p>\n<p>        judgments of the Division Bench to hold that the writ<\/p>\n<p>        petitioner being a permanent employee of the Minor<\/p>\n<p>        Irrigation Department was entitled and was rightly paid the<\/p>\n<p>        scale of head clerk of the said Department. On that account a<\/p>\n<p>        direction has been given for re-fixation of the retiral benefits<\/p>\n<p>        of the petitioner within a fixed period.<\/p>\n<p>                       We find no good reason to interfere with the<\/p>\n<p>        order of the writ court.
