This penal provision is again a pointer of\n  nature of proviso to comply with {he\n2 Woon(i\u20acfions',\u00e9tated therein To put it in other way, the\nA $a1'ci.ooTk\u00a7Zitions being mandatory, are to be satisfied If\n\"cm order of dtbcharge or dismissal passed under Section\n 33(2}{b) is io be operative. If an empioyer desires to\n'A : taic\u00e9bene\ufb01t of the said provision for passing an order of\n, iiischarge or dismissal! of an employee, he has also to\n fake ihe burden of discharging the statutory obligation\nplaced on him in the said proviso. Taking a contrary\nview that an order of discharge or dismrssal passed by\n\nan employer in contravention of the mandatory\nconditions contained in the proviso does not render such\n\nan order inoperative or void, defeats the very purpose of\n\nthe proviso and it becomes meaningless. The mistake appears to be\n\nthe Management should not have sought for\n\nwnihdrawal of the application. However, the Industrial Tribunal\nhas closed the said application only on the ground of raising of\n\ndispute by the Worlmen.
