Mr.P.Srinivas\n\n:ORDER\n<\/pre>\n<p>\tThis Writ Petition has been filed for the issuance of a Writ of Mandamus<br \/>\nto direct the respondent to consider the petitioner&#8217;s representation, dated<br \/>\n22.08.2008, in accordance with law, pursuant to the Resolution No.528, passed on<br \/>\n09.09.1970.\n<\/p>\n<p>\t2. Heard Mr.P.Srinivas, the learned counsel appearing on behalf of the<br \/>\nrespondent. With the consent of both parties, the writ Petition is taken up for<br \/>\nfinal disposal.\n<\/p>\n<p>\t3. In view of the Resolution passed by the respondent\/Palani Municipality,<br \/>\ndated 09.09.1970, the learned counsel appearing on behalf of the petitioner had<br \/>\nsubmitted that it would suffice, if the petitioner is permitted to make a<br \/>\nrepresentation  to the respondent, for the allotment of an alternative site, as<br \/>\nprayed for in the present Writ Petition               and if the respondent is<br \/>\ndirected to dispose of the said representation of the petitioner, on merits and<br \/>\nin accordance with law, within a specified period fixed by this Court.\n<\/p>\n<p>\t4. Mr.P.Srinivas, the learned counsel appearing on behalf of the<br \/>\nrespondent, did not have any objection for such an order being passed by this<br \/>\nCourt.\n<\/p>\n<p>\t5.  In view of the submissions made by the learned counsels appearing on<br \/>\neither side, without going into the merits of the case, the petitioner is<br \/>\npermitted to submit a representation,  as prayed for by him,  within a period<br \/>\nof ten days from today, enclosing a copy of the Resolution of the<br \/>\nrespondent\/Palani Municipality, dated 09.09.1970, to the respondent and on<br \/>\nreceipt of such a representation, the respondent is directed to dispose of the<br \/>\nsame, on merits and in accordance with law, within a period of 12 weeks<br \/>\nthereafter, after giving an opportunity of the hearing to the petitioner, as<br \/>\nwell as to the other parties concerned.\n<\/p>\n<p>\t6. With the above directions, the Writ Petition is disposed of.
