Justice K.T.SANKARAN\n\n Dated :16\/10\/2009\n\n O R D E R\n                         K.T.SANKARAN, J.\n            ------------------------------------------------------\n                     B.A. NO. 5892 OF 2009\n            ------------------------------------------------------\n            Dated this the 16th day of October, 2009\n\n\n                               O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. The petitioner is the first accused<\/p>\n<p>in Crime No.684 of 2006 of Karunagappally Police Station, which is<\/p>\n<p>now pending as C.P.No.76 of 2009, on the file of the Court of the<\/p>\n<p>Judicial Magistrate of the First Class, Karunagappally.<\/p>\n<p>      2. The offence alleged against the petitioner is under Section<\/p>\n<p>55(g) and (h) of the Abkari Act.\n<\/p>\n<\/p>\n<p>      3. It is submitted that a non-bailable warrant was issued by<\/p>\n<p>the Magistrate&#8217;s Court.         The petitioner apprehends arrest in<\/p>\n<p>execution of the warrant.\n<\/p>\n<\/p>\n<p>      4. <a href=\"\/doc\/876043\/\">In Vineeth Somarajan v. State of Kerala<\/a> (2009 (3) KHC<\/p>\n<p>471), it was held that where non-bailable warrant is issued by the<\/p>\n<p>court on account of non-appearance of the accused, the remedy of<\/p>\n<p>the accused is to file an application for withdrawal of the warrant and<\/p>\n<p>B.A. NO. 5892 OF 2009<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p>for the grant of bail. It was also noticed in that decision that when<\/p>\n<p>such an application for bail is filed, the learned Magistrate has to<\/p>\n<p>dispose of the Bail Application taking into account the principles laid<\/p>\n<p>down in <a href=\"\/doc\/1362546\/\">Biju v. State of Kerala<\/a> (2007(2) KLT 280).<\/p>\n<p>      5. <a href=\"\/doc\/1158859\/\">In Sukumari v. State of Kerala<\/a> (2001 (1) KLT 22) it was<\/p>\n<p>held that the power under Section 437 can be exercised even in<\/p>\n<p>cases where offence is triable exclusively by the Court of Sessions.<\/p>\n<p>      In the light of the aforesaid decisions, I am of the view that the<\/p>\n<p>remedy of the petitioner is to apply for withdrawal of the warrant and<\/p>\n<p>for the grant of bail. Reserving the liberty of the petitioner to do so,<\/p>\n<p>this Bail Application is closed.
