Rule<br \/>\n\tis fixed forthwith at the request of learned counsels for the<br \/>\n\tparties.\n<\/p>\n<p>\tPetitioner-workman<br \/>\n\thas preferred this petition under Art.226 and 227 of the<br \/>\n\tConstitution of India challenging the order dated 3-9-2007 passed by<br \/>\n\tthe Presiding Officer, Labour Court, Nadiad, rejecting his reference<br \/>\n\tbeing Reference (LCA) No.59 of 2001 (Old No.63 of 1993) on various<br \/>\n\tgrounds mentioned thereunder.\n<\/p>\n<p>\tMr.A.S.Asthavadi,<br \/>\n\tlearned advocate appearing for the petitioner, contended that the<br \/>\n\tLabour Court has recorded finding contrary to the evidence on record<br \/>\n\tso far as completion of 240 days in the preceding year is concerned.<br \/>\n\t He submitted that the document at exh.27 was document produced by<br \/>\n\tthe employer, respondent herein above,and even a glance at the<br \/>\n\tdocument shows that the workman has completed 240 days in the<br \/>\n\tpreceding year.  Copy of the said document is heavily relied upon by<br \/>\n\tMr.Asthavadi and he submitted that in view of this, let there be<br \/>\n\tremand the matter to the learned Labour Court for recording its<br \/>\n\tfinding on this aspect.\n<\/p>\n<p>\tMr.Desai,<br \/>\n\tlearned advocate appearing for the respondent, candidly admitted<br \/>\n\tthat this is a document produced by the present respondent-employer<br \/>\n\tbefore the Labour Court as it is mentioned on internal page No.4 of<br \/>\n\tthe award and on Page-9 and, therefore, the same is required to be<br \/>\n\ttaken into consideration. Mr.Desai, however, could not point out<br \/>\n\tfrom this document as to how the Labour Court has come to the<br \/>\n\tconclusion that 240 days are not completed.  He submitted that the<br \/>\n\tLabour Court has actually decided the matter against the petitioner<br \/>\n\ton other grounds also. However, he submitted that the petitioner&#8217;s<br \/>\n\tengagement with other employer after his termination, has not been<br \/>\n\trightly believed by the concerned Court.  Mr. Desai for the<br \/>\n\trespondent could not advance any other submission in support of the<br \/>\n\taward impugned.\n<\/p>\n<p>\tThis<br \/>\n\tCourt has gone through the award. The matter deserves to be remanded<br \/>\n\tback to the concerned Court only on the aspect of its finding with<br \/>\n\tregard to non-completion of 240 days.  It was not open for the Court<br \/>\n\tto record its finding contrary to the document adduced by the<br \/>\n\temployer which on the face of it, indicates that the workman did<br \/>\n\tcomplete more than 240 days in the preceding year of his<br \/>\n\ttermination.  Other issues are not commented upon as no such<br \/>\n\tsubmissions are canvassed in those behalf.  Suffice it to say that<br \/>\n\tthe matter deserves to be remanded back.  The award impugned is<br \/>\n\tquashed and set aside only on this aspect with a liberty to both the<br \/>\n\tsides to adduce evidence available in support of their case in<br \/>\n\trespect of all the issues.  It would be open to both the parties to<br \/>\n\ttake up all the contentions including that of maintainability.  The<br \/>\n\tLabour Court shall decide the reference preferably within six months<br \/>\n\tfrom the date of receipt of writ by this Court.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
