The presence of the other parties<br \/>\n\tto the proceedings would not be required at this stage.\n<\/p>\n<p>The<br \/>\n\tpresent application is for interim injunction against the execution,<br \/>\n\toperation and implementation of the impugned judgement and award<br \/>\n\tpending the first appeal.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, there shall be interim injunction<br \/>\n\tagainst the execution and implementation of the impugned judgement<br \/>\n\tand award dated 11.2.2010 on condition that the applicant deposits<br \/>\n\tthe entire awarded amount together with the interest and cost with<br \/>\n\tthe Tribunal within a period of six weeks from today.  The amount<br \/>\n\talready deposited shall be given set off and the remaining amount,<br \/>\n\tif any, shall be deposited.\n<\/p>\n<p>We<br \/>\n\thave heard learned Counsel appearing for both the sides on the<br \/>\n\taspect of withdrawal.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, out of the amount, which is or may be<br \/>\n\tdeposited, 30% of the amount shall be permitted to be withdrawn by<br \/>\n\tthe original claimants and 70% of the amount shall be invested by<br \/>\n\tthe Tribunal in the Fixed Deposit Receipts, initially for a period<br \/>\n\tof three years and such deposit shall be renewed from time to time<br \/>\n\tuntil the appeal is finally disposed of, and such investment shall<br \/>\n\tbe with the stipulation that the original claimants would be<br \/>\n\tentitled for the periodical interest on such investment from time to<br \/>\n\ttime, until the appeal is finally disposed of.\n<\/p>\n<p>Hence,<br \/>\n\tordered accordingly.
