SHAH\n\t\t\n\t\n\n \n\nDate\n: 01\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tMr.Gondalia,<br \/>\nlearned advocate appearing on behalf of the petitioner has stated at<br \/>\nthe bar that without prejudice to the rights and contentions of the<br \/>\npetitioner in the main petition, the petitioner is ready and willing<br \/>\nto deposit entire amount due and payable towards maintenance of his<br \/>\nSon- Dhaval, as per order of interim maintenance passed by the<br \/>\nlearned Family Court, confirmed by this Court in Special Criminal<br \/>\nApplication No.787 of 2010 and another cognate Special Criminal<br \/>\nApplication, within a period of two weeks from today. However, he has<br \/>\nrequested to release the petitioner on bail so that he can get out<br \/>\nof the Jail and manage for the funds from his relatives.\n<\/p>\n<p>2.\t\tUnder<br \/>\nthe instruction received from the petitioner, learned advocate<br \/>\nappearing on behalf of the petitioner has submitted that entire<br \/>\namount due and payable towards maintenance of his Son- Dhaval  as per<br \/>\norder of interim maintenance passed by learned Family Court, shall be<br \/>\ndeposited before Family Court within a period of two weeks from<br \/>\ntoday. Hence, S.O. to 20th December,2010.\n<\/p>\n<p>3.\t\tIn<br \/>\nthe meantime, the petitioner be released on bail executing a personal<br \/>\nbond of Rs.5,000\/- and with one surety of like amount before the Jail<br \/>\nAuthority, so as to enable the petitioner to deposit the aforesaid<br \/>\namount due and payable towards maintenance of his Son- Dhaval,  as<br \/>\nper order of interim maintenance passed by learned Family Court,<br \/>\nRajkot.
