JAGANNADHA RAO\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R.\n<\/p>\n<p>JAGANNADA RAO.J.\n<\/p>\n<p>     The appellant  contends that  the notice  dated 23.1.89<br \/>\nfor compulsory\tretirement issued  under Rule 10(4)(a)(i) of<br \/>\nthe Maharastra Civil Service (Pension) Rules, 1982 is bad as<br \/>\nmuch as\t the procedure\tindicated in the  Circular issued by<br \/>\nthe State  Government on  1.9.1983  has\t not  been  followed<br \/>\nbefore the  appellant crossed 50 years and his case  must be<br \/>\ndeemed to  have reviewed  in his  favour before\t crossed  50<br \/>\nyears. In such a situation, a second review after he crossed<br \/>\n50 years is, according to the appellant, not permissible.<br \/>\nIt is  also contented  that it is not open to the respondent<br \/>\nwhile  issuing\tnotice\ton  23.1.1989  to  apply  the  norms<br \/>\nprescribed in  a latter\t Circular  dated  12.5.1986.  It  is<br \/>\ncontended that\twhile the  23.1.1983 Circular\tprescribed a<br \/>\nstandard  of  not  less\t than  average\tthe  Circular  dated<br \/>\n12.5.1986 prescribed  a more stringent standard of &#8216;not less<br \/>\nthan  good&#8217;.  If  review  had  been  undertaken\t before\t the<br \/>\nappellant  crossed   50\t years,\t than  it  would  have\tbeen<br \/>\nsatisfied the  standard of  &#8216;less than\taverage&#8217; &#8211; which, in<br \/>\nfact, he  did &#8211;\t as per the norms prescribed by the circular<br \/>\ndated 1.9.1983.\t The contention of the appellant is that the<br \/>\ncircular dated\t1.9.1983 is binding on the Government and is<br \/>\nintended  to   see  that   the\tgeneral\t  power\t under\tRule<br \/>\n10(4)(a)(i) is not used arbitrarily.\n<\/p>\n<p>     After hearing  learned senior council on both sides, we<br \/>\nwere prima  facie inclined to accept the above contention of<br \/>\nthe appellant.\tBut we have come to notice a two Judge Bench<br \/>\ndecision in  <a href=\"\/doc\/1606013\/\">Suryakant Govind  Oke vs.\tState of Maharashtra<\/a><br \/>\n[1995 Suppl.  (2) SCC  420] wherein it has held that even if<br \/>\nan officer&#8217;s case has not been reviewed before he crossed 50<br \/>\nyears, his  case can  be reviewed  under the  circular dated<br \/>\n12.5.1986 read\twith Rule  10(4)(a)(i) of the Rule, and that<br \/>\nthis could  be done  even after he has crossed 50 years.  We<br \/>\nhave, therefore,  thought it  fit that\tthe case  is  to  be<br \/>\ndecided by a three Judge Bench.\n<\/p>\n<p>     In this  context, we are of the view that the decisions<br \/>\nin Union  of India &amp; others vs. Narsirmiya Ahmadmiya Chauhan<br \/>\n[1994 Suppl.  (2)  SCC\t537],  <a href=\"\/doc\/548828\/\">K.  Chelliah  vs.  Industrial<br \/>\nFinance Corporation  of India &amp; Another<\/a> [1992 Suppl. (3) SCC<br \/>\n82] and in <a href=\"\/doc\/1268556\/\">Brij Mohan Singh Chopra vs. State of Punjab<\/a> [1987<br \/>\n(2) SCC\t 188] decided  by Benches  of two  Judges and also a<br \/>\ndecision of  a three  Judges Bench  in\t<a href=\"\/doc\/1576896\/\">State  of  U.P.\t vs.<br \/>\nChandra Mohan  Nigam<\/a> [1978 (1) SCR 521] &#8211; all concerning the<br \/>\neffect\tof   Circulars\/guidelines  dealing  with  compulsory<br \/>\nretirement &#8211; are also relevant.\n<\/p>\n<p>     We direct\taccordingly that the papers be placed before<br \/>\nthe Hon&#8217;ble  the Chief\tJustice of  India, for\tbeing listed<br \/>\nbefore a Bench of three learned Judges.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Meghra Urkudaji Tempe vs The State Of Maharastra on 13 May, 1998 Author: J Rao.J.
