No.10276 of 2011\n                     NAWLESH YADAV SON OF DOMAN YADAV.\n                                             Versus\n                                THE STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>2   20.04.2011                Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The petitioner being the co-villager of the<\/p>\n<p>                 informant is apprehending his arrest in a case registered<\/p>\n<p>                 under Sections 341, 323 and 307\/34 of the Indian Penal<\/p>\n<p>                 Code and Section 27 of the Arms Act.\n<\/p>\n<p>                              The accusation against the petitioner is to<\/p>\n<p>                 have caused firearm injury.\n<\/p>\n<p>                              It is submitted that the petitioner was also<\/p>\n<p>                 accompanied by another persons.\n<\/p>\n<p>                              It is further submitted that the occurrence<\/p>\n<p>                 took place on 18.12.2010 at 8.00 PM in the night<\/p>\n<p>                 whereas, the fardbeyan was recorded on 19.12.2010 at<\/p>\n<p>                 9.30 AM in Sadar Hospital, Lakhisarai, which was<\/p>\n<p>                 registered as a police case on 19.12.2010 at 3.30 PM.<\/p>\n<p>                 The injury report reflects one injury on the left elbow<\/p>\n<p>                 joint. The victim received injury on 18.12.2010<\/p>\n<p>                 whereas, he was examined by the doctor on 19.12.2010<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>             and thereafter, the fardbeyan was recorded.<\/p>\n<p>                       Such a delay in medical examination of the<\/p>\n<p>             informant and lodging of the F.I.R. cloud the bona fide<\/p>\n<p>             of the accusation.\n<\/p>\n<p>                       Considering the aforesaid submissions, let<\/p>\n<p>             the above named petitioner, be released on anticipatory<\/p>\n<p>             bail, in the event of his arrest or surrender before the<\/p>\n<p>             learned Court below within a period of 12 weeks from<\/p>\n<p>             today, on furnishing bail bond of Rs. 10,000\/- (ten<\/p>\n<p>             thousand) with two sureties of the like amount each to<\/p>\n<p>             the   satisfaction     of   the    learned   Chief   Judicial<\/p>\n<p>             Magistrate, Lakhisarai in connection with Chanan P.S.<\/p>\n<p>             Case No. 65\/2010, subject to the conditions as laid<\/p>\n<p>             down under Section 438(2) Cr.P.C.\n<\/p>\n<\/p>\n<p>                                               (Dinesh Kumar Singh, J.)<br \/>\nAmrendra\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nawlesh Yadav vs The State Of Bihar on 20 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
