SHAH\n\t\t\n\t\n\n \n\nDate\n: 20\/10\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\nfor implementation of the award passed by the Labour Court, Bhavnagar<br \/>\ndated 24\/07\/2000 in Reference (L.C.B.) No. 169\/1995.\n<\/p>\n<p>2.\tIt<br \/>\nappears that by way of interim relief the learned Single Judge<br \/>\ndirected the respondent-Corporation to reinstate the petitioner in<br \/>\nservice.\n<\/p>\n<p>3.\tToday<br \/>\nwhen the petition is taken up for hearing, Shri Desai, learned<br \/>\nadvocate appearing on behalf of the respondent-Corporation has stated<br \/>\nat the bar that the petitioner has been reinstated in service in the<br \/>\nyear 2004 and so far as back wages to be paid to the petitioner as<br \/>\nper the judgement and award passed by the Labour Court till he his<br \/>\nreinstated in service is concerned, the same must have been paid and<br \/>\nif not paid the same shall be paid within a period of eight weeks<br \/>\nfrom today.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, when the petitioner is already reinstated in<br \/>\nservice, no further order is required to be passed so far as<br \/>\nreinstatement is concerned and so far as back wages as per the<br \/>\njudgement and award passed by the Labour Court, Bhavnagar till the<br \/>\npetitioner is reinstated in service is concerned, if the same is not<br \/>\npaid by the respondent, the same shall be paid to the petitioner<br \/>\nwithin a period of eight weeks from today.\n<\/p>\n<p>5.\tWith<br \/>\nthis, the present petition is allowed.  Rule is made absolute to the<br \/>\naforesaid extent.
