DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tLearned<br \/>\nadvocate for the appellant submits that in the opinion of the learned<br \/>\nJudge, the appellant &#8211; defendant was not obliged to serve any<br \/>\nnotice to the consumer prior to disconnecting the electricity supply<br \/>\nwhen prima facie evidence of theft of energy or malpractice is found<br \/>\nby the competent authority of the defendant company.  The learned<br \/>\nJudge, however, examined the question as to whether the plaintiff has<br \/>\ncommitted theft of energy or malpractice and finally held that<br \/>\nsection 26 of the Indian Electricity Act, 2010 was applicable and<br \/>\nfailure to do so on the part of the electricity company would entitle<br \/>\nthe plaintiff to decree in his favour, as prayed for.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the appellant relying on the decisions of the Apex Court<br \/>\nin the cases of [i] <a href=\"\/doc\/316379\/\">Bombay Electric Supply and Transport Undertaking<br \/>\nv. Laffans (I) Pvt. Ltd.<\/a> [AIR 2005 SC 2486] and [ii] <a href=\"\/doc\/506864\/\">Sub-Divisional<br \/>\nOfficer (P), UHBVNL v. Dharam Pal<\/a> [AIR 2007 SC 1214] and submits that<br \/>\nin cases of theft and malpractice, applicability of section 26 or<br \/>\neven provision of 26(6) of the Electricity Act, 1910 would not be<br \/>\napplicable.\n<\/p>\n<p>\tHowever,<br \/>\nlearned advocate for the respondent is not present.\n<\/p>\n<p>\tHence,<br \/>\npost the matter on 15.09.2011.\n<\/p>\n<p>[Anant<br \/>\nS.
