Justice M.C.HARI RANI\n\n Dated :23\/05\/2009\n\n O R D E R\n                           R.BASANT &amp;\n                      M.C.HARIRANI, JJ.\n                    * * * * * * * * * * * * *\n                    W.P.(Crl).No.125 of 2009\n                   ----------------------------------------\n              Dated this the 23rd day of May 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>BASANT,J<\/p>\n<p>      The petitioner has filed this writ petition under Article 226<\/p>\n<p>of the Constitution of India for issue of a writ of habeas corpus to<\/p>\n<p>trace and produce his daughter Sumitha aged 26 years. The<\/p>\n<p>marriage of Sumitha with the 7th respondent was solemnised on<\/p>\n<p>14\/12\/2008. She was at the matrimonial home from where she<\/p>\n<p>was allegedly found to be missing from 03\/03\/2009. As the<\/p>\n<p>petitioner apprehended foul play at the matrimonial home, he<\/p>\n<p>had approached this court with this writ petition to enable him to<\/p>\n<p>trace and secure the presence of his daughter.<\/p>\n<p>      2.  This writ petition was admitted to file on 22\/3\/2009.<\/p>\n<p>The daughter of the petitioner could not be traced till<\/p>\n<p>07\/04\/2009 and thereafter the case was posted to this date.<\/p>\n<p>Today, the police have been able to trace the petitioner&#8217;s<\/p>\n<p>daughter Sumitha and she has been produced before court. It is<\/p>\n<p>submitted that she was earlier produced before the learned<\/p>\n<p>Magistrate having jurisdiction.           The alleged detenu Sumitha<\/p>\n<p><span class=\"hidden_text\">W.P.(Crl)No.125\/09               2<\/span><\/p>\n<p>states that she had gone to Idukki from her matrimonial home to<\/p>\n<p>join a beautician course on her own.           She is not under<\/p>\n<p>confinement and she has no grievance or complaint that she is<\/p>\n<p>detained or confined against her will or desire by anyone. In<\/p>\n<p>response to a specific query by this court she submits that she<\/p>\n<p>would now like to go with her father, the petitioner herein.<\/p>\n<p>      3.    We are satisfied that the alleged detenu Sumitha is<\/p>\n<p>not under confinement or illegal detention. We are satisfied that<\/p>\n<p>no further directions are necessary in this writ petition.<\/p>\n<p>      4.    This writ petition is accordingly dismissed.
