No.33933\/2009-J\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n           Dated this the 4th day of January, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    The petitioners herein seek for a direction to the<\/p>\n<p>respondents to demarcate 2.40 acres of land allowed to the<\/p>\n<p>petitioners&#8217; predecessor in interest by this Court and<\/p>\n<p>handover the legal possession thereof within a specified<\/p>\n<p>time.  The petitioners are the legal heirs of one Vakkachan<\/p>\n<p>who  owned  5  acres  of  land  in  Survey No.216  pt.   of<\/p>\n<p>Kottappadi Village in South Wayanad Taluk.    The property<\/p>\n<p>was notified under the Kerala Private Forests (Vesting &amp;<\/p>\n<p>Assignment)  Act, 1971  and  that  led  to  the  filing  of<\/p>\n<p>O.A.No.25\/1981 by the deceased Vakachan before the Forest<\/p>\n<p>Tribunal.  His claim was allowed by the Forest Tribunal and<\/p>\n<p>the matter was taken up in an appeal, M.F.A.No.438\/1984, by<\/p>\n<p>the Forest Department.  It is averred that the Judgment in<\/p>\n<p>appeal  has  become  final.    As  regards the   claim  for<\/p>\n<p>restoration, in the counter affidavit filed by the fourth<\/p>\n<p>respondent, it is averred that the restoration will be<\/p>\n<p>effected after due survey and demarcation by the fifth<\/p>\n<p>respondent.\n<\/p>\n<p>    2.   The learned Government Pleader appearing for the<\/p>\n<p>respondents submitted that the fifth respondent may be<\/p>\n<p>W.P.(C). No.33933\/2009<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>directed to survey and demarcate the disputed property and,<\/p>\n<p>sufficient time may be granted to finalise the same.<\/p>\n<p>     3.      Therefore, there will be a direction to the fifth<\/p>\n<p>respondent to survey and demarcate the property, namely,<\/p>\n<p>2.40 acres of land in Survey No.216 pt. which was the<\/p>\n<p>subject     matter    of M.F.A.No.438\/1984  (Ext.P2  Judgment)<\/p>\n<p>within a period of three months from the date of receipt of<\/p>\n<p>a copy of this Judgment and, accordingly, depending upon<\/p>\n<p>the outcome further action will be taken for restoration of<\/p>\n<p>the property.\n<\/p>\n<p>     The writ petition is disposed of as above.
