The appellant, who is a Diploma holder in Electrical<\/p>\n<p>Engineering, was appointed to the post of Sub Engineer<\/p>\n<p>(Electrical\/Mechanical) on contract basis on 1st July, 1997.            The<\/p>\n<p>appellant    had   applied   for    the   said   post   pursuant   to   an<\/p>\n<p>advertisement in the Employment News inviting applications for<\/p>\n<p>recruitment to the said post on contract basis. It was specifically<\/p>\n<p>mentioned in the said advertisement that the appointment is on<\/p>\n<p>contract basis for two years but will be extendable upto 60 years<\/p>\n<p>LPA No.229\/2007                                               page 1 of 3<br \/>\n of age. The appellant&#8217;s contract was extended from time to time<\/p>\n<p>and last such extension being with effect from 2nd January, 2006<\/p>\n<p>to 30th June, 2006. On 1st June, 2006, the respondent No.2 issued<\/p>\n<p>an advertisement inviting tenders from reputed manpower<\/p>\n<p>providing agencies for recruitment, amongst others, to the post of<\/p>\n<p>Sub Engineer (Mech.\/Civil), by outsourcing the same on contract<\/p>\n<p>basis. The appellant assailed the said advertisement on the basis<\/p>\n<p>that the appellant having worked in the post of the Sub-Engineer<\/p>\n<p>(Elec.\/Mech.) for nine years, he is entitled to continue in service<\/p>\n<p>and his services ought to be regularised w.e.f. 5th July, 1997.<\/p>\n<p>2.     The learned single Judge has held that the appellant was<\/p>\n<p>appointed only as a contractual employee and not against any<\/p>\n<p>permanent or sanctioned post.      The appointment letter clearly<\/p>\n<p>stated that his employment is contractual, for a period of two<\/p>\n<p>years and that during the period of the contract, a consolidated<\/p>\n<p>pay of Rs.5,000\/- shall be payable.       There is no violation of<\/p>\n<p>Articles 14 or 16 of the Constitution in not regularising the<\/p>\n<p>services of the appellant and consequently the appellant is not<\/p>\n<p>entitled to any relief.\n<\/p>\n<p>3.     In our opinion, in view of the decisions of the Supreme<\/p>\n<p>Court in <a href=\"\/doc\/1591733\/\">Secretary, State of Karnataka and Ors. v. Umadevi<\/p>\n<p>LPA No.229\/2007<\/a>                                           page 2 of 3<br \/>\n (3)   and   Ors.   [(2006)   4    SCC    1],   <a href=\"\/doc\/148450\/\">Mineral   Exploration<\/p>\n<p>Corporation    Employees&#8217;        Union    v.   Mineral   Exploration<\/p>\n<p>Corporation Limited and Anr.<\/a> [(2006) 6 SCC 310], <a href=\"\/doc\/1845696\/\">Municipal<\/p>\n<p>Corporation, Jabalpur v. Om Prakash Dubey<\/a> [2006 (13) Scale<\/p>\n<p>266   and   <a href=\"\/doc\/505590\/\">Indian   Drugs       and    Pharmaceuticals     Ltd.   v.<\/p>\n<p>Workman, Indian Drugs and Pharmaceuticals Ltd.<\/a> [(2007)<\/p>\n<p>1 SCC 408], the prayer of the appellant for regularisation cannot<\/p>\n<p>be accepted.    The learned single Judge has rightly declined to<\/p>\n<p>grant any relief to the appellant. The appeal has no merit.
