SHAH\n\t\t\n\t\n\n \n\nDate\n: 12\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, the petitioners &#8211; wife and minor child, have prayed<br \/>\nfor an appropriate order directing the learned Trial Court to<br \/>\nforthwith decide and dispose of Criminal Misc.Application<br \/>\nNo.715\/2011, which has been submitted by the petitioners under<br \/>\nSection 125(3) of the Code of Criminal Procedure directing the<br \/>\nrespondent-husband to pay amount of maintenance as per the judgement<br \/>\nand award passed by learned Family Court No.2, Ahmedabad in Criminal<br \/>\nMisc.Application No.1905 of 2008.\n<\/p>\n<p>2.\t\tA<br \/>\ngrievance, which is voiced in the present petition is that despite<br \/>\nthe fact that the petitioners have submitted application for<br \/>\nmaintenance in the year 2008 and the same is finally decided and<br \/>\ndisposed of by the learned Judge of Family Court No.2, Ahmedabad on<br \/>\n19th January,2010, the petitioners are not in a position<br \/>\nto enjoy the fruits of the said order and it is very difficult for<br \/>\nthe petitioners to maintain themselves in these hard days.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard Mr.Ashish Dagli, learned advocate appearing on behalf of the<br \/>\npetitioners and considering the fact that there is an order in favour<br \/>\nof the petitioners by learned Judge, Family Court No.2, Ahmedabad<br \/>\nawarding maintenance as far back on 19th January,2010 and<br \/>\nit is reported that the petitioners have not being paid any amount by<br \/>\nthe respondent-husband, looking to the nature of controversy and<br \/>\npurpose for which the amount of maintenance awarded is not<br \/>\nfrustrated, learned Family Court before whom, application under<br \/>\nSection 125(3) of the Code of Criminal Procedure is pending, is<br \/>\nhereby directed to see that the aforesaid Criminal Misc.Application<br \/>\nNo.715\/2011 is decided and disposed of at the earliest and\/or in the<br \/>\nmeantime, some effective order is passed so that the petitioners can<br \/>\nmaintain themselves and the order passed by the learned Family Court<br \/>\nNo.2, Ahmedabad in awarding maintenance is complied with.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present petition is disposed of.
