The appellants have preferred this appeal<\/p>\n
challenging the order of the trial Court in dismissing the<\/p>\n
Misc. Petition No.96′?\/99 both on the ground of delay as
\nwell as on merits.\n<\/p>\n
2. It is the case of the appellants that the<\/p>\n
respondent \ufb01led a suit in O.S. No.5183\/1995 against<\/p>\n
Karigowda the husband of appellant No.l(a) <\/p>\n
of appellant Nos.l[b) to 1{d) for permanent:” <\/p>\n
and managed to obtain an exiparte <\/p>\n
Decree against him. Karigowda _to  thes’a’me*,<\/p>\n
for the first time through th”ee\u00abc:.iI\u00a7\/*:fitten ‘sta’te\ufb01ief1itV”\ufb01ied by it<\/p>\n
the respondent in thesuit \/Qgvlfiled by him<\/p>\n
against “”” “th_e”i; resjpon’dent fo’1″*perrnanent injunction.<\/p>\n
Immediately’ coupnesselig… made an application on<\/p>\n
26\/6\/l9\u00a3V\u00a79′..to’r  the certi\ufb01ed copy of the said<\/p>\n
 judgrnentand decree. I-Iis counsel received it<\/p>\n
“‘i1o;k:pi:ti\/1999 and handed over to him on<\/p>\n
1l8_\/[ll \/p1.99′ 9’ and Misc. 967\/99 was \ufb01led on<\/p>\n
“‘-..20\/ll\/V__l7-999 and it was filed Within 30 days from the<\/p>\n
 knowledge of ex~parte Judgment and Decree.<\/p>\n
__The suit summons issued to him in O.S. No.5l93\/95<\/p>\n
it was not served on him. At the time of<\/p>\n
alleged service of suit summons at premises<\/p>\n
No.33 he was in his office, the trial Court
\n ,<\/p>\n
Without considering this aspect of the matter dismissed
\nthe Misc. petition both on the ground of delay as well as<\/p>\n
on merits. Hence, they Preferred this appeal. ‘If  ”<\/p>\n
3. Learned counsel appearing for tlie’ <\/p>\n

The respondent in the  V.tit1e’=r:.f-  9 suit 9′<\/p>\n
O.S.No.5183\/95 has ehewnttiheffeaarees of vtheindeceased
\nKarigowda as No.33 and   issued to<\/p>\n
him on 12\/12’\/\u00abi995 to me  D.No.33 as if he<\/p>\n
was residin.g”jtheJre;’–The”*Ciourt”b’ailiff submitted a report
\nstatinggthat heVVr4e”fused’f’t.oreceive the summons when it<\/p>\n
was soughte t’o._be  on him on 12\/12\/1995 at<\/p>\n
  at vrhicirtyime he was in his office. On the<\/p>\n
  false refusal shara. the trial Court<\/p>\n
placed him:3–.Ve)}t\u00abparte and proceeded to pass the eX~parte<\/p>\n
V’~\u00bb.Judgnient and Decree against him on 18\/ 6\/ 1987. The<\/p>\n
V”‘x_’resp:ondent after obtaining the decree did not \ufb01le<\/p>\n

  with a Shara that he has refused to<\/p>\n

“””.;-ighjlfiy held the service of suit summons on Karigowda<\/p>\n
    sufficient and passed the Judgment and Decree on<\/p>\n
merits. He further submits that the decree obtained by<\/p>\n
the respondent against Karigowda being one for bare<\/p>\n

injunction it cannot be set aside at the instance of his
\nlega} heirs as no cause of action survives. He further<\/p>\n
submits, the Misc. petition is filed after an inordinate<\/p>\n
delay and no sufficient cause is shown foi’:–.corid}\u00a7niiig’ <\/p>\n
the said delay and he prays for disiI1_issaI;’o’f  it if<\/p>\n
5. I have heard the leainedtlcounsel <\/p>\n

\nthe sale “1980 he constructed a<\/p>\n
residentia1″house’;.andit was assigned premises No.32<\/p>\n
 at  cross, Muneshwara Block,<\/p>\n
  and it is different from the alleged<\/p>\n
property of respondent and he came to know about<\/p>\n
 exparte Judgment and Decree obtained by the<\/p>\n
v.”VV.res_pj’:cindent against him for the first time when the<\/p>\n
   __r.espondent \ufb02ied written statement in O.S. No.4372\/ 99<\/p>\n
if disclosing about the eX~parte Judgment and Decree and<\/p>\n
immediately his counsel applied for the certi\ufb01ed copy of<\/p>\n
g.\n<\/p>\n
the Judgment and Decree and fiied the Misc. petition<\/p>\n
within 30 days from the date of knowledgee~.V_o\u00a3’_t’t..he<\/p>\n
eX–parte Judgment and Decree. It is not   <\/p>\n
the respondent after obtaining__the_exparte–:’_;;ddgn1e11tu it<\/p>\n
and Decree on 18\/6\/1986 end  ‘tic.’r_1v”ose <\/p>\n

\naddress' 'shown as D.No.33 and it was<\/p>\n
sought to"be"ser?Jed._:o'ri'1V him at D.No.33, whereas the<\/p>\n
  Karigowda bears the Door No.32. The<\/p>\n
  ;:jr'oduced by Karigowda ciearly establish<\/p>\n
 he. \ufb01fas't::working in the office of Asst. Executive<\/p>\n
Engineer, P.W.D. and he was on duty on 12\/12\/1995<\/p>\n
v."V'.Aa:3.,dj'f:that the Shara written by the court bailiff stating<\/p>\n
 __that Karigowda refused to take the suit summons is<\/p>\n
nothing but false hood. Further in the evidence of the<\/p>\n
court bailiff examined as C.W.i, he has stated that he<\/p>\n
about the ex parte judgment and decree obtained by<\/p>\n
him against Karigowda. if that is so then <\/p>\n
petition \ufb01led by Karigowda is to be held  <\/p>\n
within 30 days from the date of Vthegjex; it 2<\/p>\n
parte judgment and decree. If the <\/p>\n
got a genuine case against"-r..the A'appellants._;"eveh by"?<\/p>\n

The _facts'~.and.Vpcircuiiistances of the case warrant<\/p>\n
  of zrniscV."petition and setting aside the eX–parte<\/p>\n
  Decree obtained by the respondent<\/p>\n
agilgstxaillgowda in o.s. No.5183\/95. The trial Court<\/p>\n
comniltted a grave error in holding that the delay in<\/p>\n
 the misc. petition is not explained and there is no<\/p>\n
   .,,_St1f\ufb01cient reason for setting aside the exwparte judgment<\/p>\n
and decree passed in O.S.No.5l83\/95. The approach of<\/p>\n
trial Court is perverse and is liable to be interfered with.<\/p>\n

Accordingly, the appeal is allowed.<\/p>\n

Misc. No.96′?\/99 on the file of V <\/p>\n
and Sessions Judge, Bangalore  _  <\/p>\n
