Justice ANTONY DOMINIC\n\n Dated :25\/10\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n             = = = = = = = = = = = = = = = =\n               W.P.(C) No. 31755 OF 2007 E\n             = = = = = = = = = = = = = = = =\n\n            Dated this the 25th October, 2007\n\n                     J U D G M E N T\n<\/pre>\n<p>    The prayer made in this writ petition is to direct<\/p>\n<p>the 1st and 4th respondents not to issue drug license to<\/p>\n<p>the 5th respondent.      Petitioner is also seeking a<\/p>\n<p>declaration   that   the  5th  respondent  is  not   the<\/p>\n<p>subsidiary of the 2nd respondent and a prohibition to<\/p>\n<p>the 2nd respondent not to do any business through the 5th<\/p>\n<p>respondent is also sought for.   The basic contention of<\/p>\n<p>the petitioner is that the 5th respondent is styling<\/p>\n<p>itself as a subsidiary of the 2nd respondent which in<\/p>\n<p>fact it is not.     It is on that basis the petitioner<\/p>\n<p>seeks an order directing that the 5th respondent shall<\/p>\n<p>not be granted the drug license.\n<\/p>\n<p>    2. Petitioner does not have a case or at least<\/p>\n<p>pleaded in the writ petition that the 5th respondent<\/p>\n<p>suffers from any ineligibility to be granted a license<\/p>\n<p>to do business in pharmaceutical products.   If that be<\/p>\n<p>so, the fact that it is not a subsidiary cannot render<\/p>\n<p><span class=\"hidden_text\">WPC No. 31755\/07             -2-<\/span><\/p>\n<p>it ineligible to issue a license for which it is<\/p>\n<p>otherwise eligible to.\n<\/p>\n<p>    3.     If   as  stated  by  the  petitioner,   the 5th<\/p>\n<p>respondent is falsely representing as the subsidiary of<\/p>\n<p>the 2nd respondent, it is for the 2nd respondent to take<\/p>\n<p>appropriate action and remedy the situation.          That<\/p>\n<p>cannot be taken advantage of by the petitioner, who is<\/p>\n<p>also    a   dealer   in   pharmaceutical  products   whose<\/p>\n<p>intention is only to prevent opening an other outlet<\/p>\n<p>selling similar products.     I see no merit in the writ<\/p>\n<p>petition.
