RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n            W.P.(C).No.10422 of 2009-W\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n     Dated this the 15th day of September, 2009.\n\n                     JUDGMENT\n<\/pre>\n<p>1.Lands of the petitioners were acquired for the<\/p>\n<p> purpose of GCDA. A reference was made in relation<\/p>\n<p> to certain other items of lands covered by the<\/p>\n<p> same notification. The Reference Court answered<\/p>\n<p> that reference. The matter was pending in an<\/p>\n<p> appeal before this Court. Relying on the award of<\/p>\n<p> the   Reference  Court,    the  petitioners   filed<\/p>\n<p> applications under Section 28A(1) of the Land<\/p>\n<p> Acquisition Act, 1894. The pendency of those<\/p>\n<p> applications is the cause of this writ petition.<\/p>\n<p>2.With the passage of time, this Court has disposed<\/p>\n<p> of the appeals. The 28A(1) applications of the<\/p>\n<p> petitioners have, therefore, to be considered and<\/p>\n<p><span class=\"hidden_text\">WP(C)10422\/09          -: 2 :-<\/span><\/p>\n<p> disposed of in accordance with law. The learned<\/p>\n<p> Government     Pleader     points out    that   the<\/p>\n<p> petitioners cannot rake up any issue relatable to<\/p>\n<p> the appellate award by this Court and have to<\/p>\n<p> confine themselves to the award passed by the<\/p>\n<p> Reference Court on the basis of which alone the<\/p>\n<p> application under Section 28A(1) is filed. That<\/p>\n<p> is also an issue that has to be considered by the<\/p>\n<p> officer     dealing with     the application  under<\/p>\n<p> Section 28A(1) and not for this Court to state to<\/p>\n<p> them in the form of a caveat as to what they<\/p>\n<p> shall do. I say this more importantly      because,<\/p>\n<p> such questions are covered by different judgments<\/p>\n<p> and are also still pending for consideration by<\/p>\n<p> this Court.\n<\/p>\n<p> In the aforesaid background, this writ petition<\/p>\n<p> is    ordered  leaving  open   all contentions  and<\/p>\n<p> directing that the applications filed by the<\/p>\n<p> petitioners forming part of this writ petition<\/p>\n<p> shall be taken up, considered and disposed of in<\/p>\n<p> accordance with law within an outer limit of two<\/p>\n<p><span class=\"hidden_text\">WP(C)10422\/09        -: 3 :-<\/span><\/p>\n<p> months from the date of receipt of a copy of this<\/p>\n<p> judgment.\n<\/p>\n<\/p>\n<p>                      THOTTATHIL B.
