SIRI JAGAN, J.\n                  ------------------------------------\n                      O.P.No. 33191 OF 2002\n                ----------------------------------------\n                Dated this the 27th day of January, 2009\n\n                             JUDGMENT\n<\/pre>\n<p>        The petitioner claims to be a victim of unauthorised<\/p>\n<p>removal of his kidney for the purpose of transplantation to<\/p>\n<p>others.     The petitioner filed this original petition alleging<\/p>\n<p>complacency on the part of the Government of Kerala and the<\/p>\n<p>police in respect of investigating the complaint properly.<\/p>\n<p>Therefore, the petitioner has filed this original petition seeking<\/p>\n<p>the following reliefs:\n<\/p>\n<blockquote><p>              &#8220;i)   Issue a Writ of Mandamus directing the 4th<br \/>\n        Respondent to take over the reigns of investigation into<br \/>\n        this notorious, kidney transplantation racket case, by<br \/>\n        constituting a special investigation team and to book the<br \/>\n        culprits and prosecute them in accordance with law.\n<\/p><\/blockquote>\n<blockquote><p>              ii)   Issue a Writ of Mandamus directing the 1st<br \/>\n        and 2nd Respondents to pay compensation to the<br \/>\n        petitioner, worth Rs.10,00,000\/- (Ten lakhs) by way of<br \/>\n        remedy under public law, and to realize the compensation<br \/>\n        amount from the assets of Respondents 7 and 9&#8243;.\n<\/p><\/blockquote>\n<p>Admittedly, subsequent to filing of this original petition, the<\/p>\n<p>Government has constituted a committee, who has gone into the<\/p>\n<p><span class=\"hidden_text\">O.P.No.33191\/2002                2<\/span><\/p>\n<p>matter and a criminal complaint has been filed before the<\/p>\n<p>appropriate Magistrate Court by the competent authority in<\/p>\n<p>which proceedings are going on before the Court.           In fact<\/p>\n<p>Criminal M.C. No.11683\/2002 in respect of the said case is<\/p>\n<p>pending before this Court. The petitioner&#8217;s contention is that<\/p>\n<p>he is not satisfied with the investigation by the local police and<\/p>\n<p>the matter should be entrusted to the C.B.I.<\/p>\n<p>      2.    I am of opinion that if the petitioner is not satisfied<\/p>\n<p>with the investigation, he can approach the appropriate<\/p>\n<p>Magistrate for appropriate orders regarding the same. As far<\/p>\n<p>as the claim for compensation is concerned, this Court cannot<\/p>\n<p>decide that question in so far as it would require adducing of<\/p>\n<p>evidence to fix the liability as well as quantum.      Therefore,<\/p>\n<p>without prejudice to the right of the petitioner to approach the<\/p>\n<p>Magistrate Court for appropriate action in accordance with the<\/p>\n<p>decision of <a href=\"\/doc\/1836621\/\">Sakiri Basu V. State of U.P.<\/a> [2008 (1) KLT<\/p>\n<p>724] and without prejudice to the right of the petitioner to file<\/p>\n<p>appropriate suits for claiming compensation, this original<\/p>\n<p>petition is closed.\n<\/p>\n<\/p>\n<p>                                        S.
