No.1 &amp;<br \/>\n2 of not initiating appropriate proceedings against the Resp. No.3<br \/>\nunder the law as the same is arbitrary, illegal, null &amp; void.\n<\/p>\n<p>(B)\tYour<br \/>\nLordships may be pleased to issue appropriate writ, order or<br \/>\ndirection, directing the Respondent No.1 &amp; 2, to exercise powers<br \/>\ngranted under B.P.M.C. Act and under the Prevention of Antisocial<br \/>\nActivities Act against the partners of Resp. No.3 and be further<br \/>\npleased to direct the Resp. No.1 &amp; 2 to initiate appropriate<br \/>\ncriminal proceedings against the Resp.  No.3.\n<\/p>\n<p>(C)\tYour<br \/>\nLordships may be pleased to issue appropriate writ, order or<br \/>\ndirection, directing the Respondent No.1 &amp; 2 to ensure that the<br \/>\nencroachment are adequately compensated, in the interest of justice.\n<\/p>\n<p>(D)\tYour<br \/>\nLordships may be pleased to direct the Respondents to comply the<br \/>\nconsent decree dtd. 28.01.84 passed by the 2nd Jt. Civil<br \/>\nJudge (SD), Junagadh, vide exh.32 in Special Civil Suit No.111 of<br \/>\n1980, by carrying out measurement for the purpose of finding out the<br \/>\nextent of the encroachment carried by the Resp. No.3 over the<br \/>\nGovernment land pending admission, hearing and final disposal of this<br \/>\nwrit petition.&#8221;\n<\/p>\n<p>2.\tPreviously<br \/>\nthough the petitioner was represented by an advocate, it appears that<br \/>\nsubsequently, the advocate was relieved. The petitioner was not<br \/>\npresent before the Court today.  Her written arguments dated<br \/>\n15.03.2010 are on record.\n<\/p>\n<p>3.\tI<br \/>\nhave perused the written arguments, the pleadings on record and heard<br \/>\nMs.Maithili Mehta, the learned AGP for the State and Mr.Anshin Desai,<br \/>\nlearned advocate for respondent no.3. From the prayers, it can be<br \/>\nseen that the petitioner desires that action be taken against<br \/>\nrespondent no.3 under Prevention of Antisocial Activities Act. It is<br \/>\nher case that respondent no.3 is a builder and influential person and<br \/>\nis encroaching municipal\/Government lands.\n<\/p>\n<p>4.\tMr.Desai,<br \/>\nlearned advocate for respondent no.3, however, pointed out that with<br \/>\nrespect to the same land which the petitioner alleges that respondent<br \/>\nno.3 has encroached, respondent no.3 had filed Civil Suit being<br \/>\nRegular Civil Suit No.648 of 1992 joining Junagadh Municipality and<br \/>\nState Government as defendants claiming ownership and possessory<br \/>\nrights of  present respondent no.3 over the land in question. In such<br \/>\nproceedings also, present petitioner was permitted to intervene and<br \/>\nthe suit came to be decreed in favour of present respondent no.3 by<br \/>\njudgment and decree dated 28.04.2010 passed by the learned Principal<br \/>\nSenior Civil Judge, Junagadh. Defendants were  prevented from<br \/>\nstopping the plaintiffs from carrying out construction on the said<br \/>\nland. He further stated that against the judgment and decree dated<br \/>\n28.04.2010, the Corporation also preferred Regular Civil Appeal No.37<br \/>\nof 2010 which came to be dismissed by judgment dated 27.09.2010<br \/>\npassed by the learned Additional District Judge, Junagadh.\n<\/p>\n<p>5.\tMr.Desai,<br \/>\nlearned advocate, pointed out that the present petitioner had filed a<br \/>\ncriminal case being C.R. I-12 of 2002 alleging commission of offences<br \/>\npunishable under Sections 418, 420 and 423 etc. of Indian Penal Code<br \/>\nwhich was summarily dropped and the summary was also finally accepted<br \/>\nby the High Court.\n<\/p>\n<p>6.\tThe<br \/>\nState Government has also filed a reply opposing the petition and<br \/>\ncontending that no case for taking action under Prevention of<br \/>\nAntisocial Activities Act is made out.\n<\/p>\n<p>7.\tWhen<br \/>\nthe Civil Court has expressed its opinion on the nature of possession<br \/>\nand title of respondent no.3 with respect to the land in question, I<br \/>\nam of the opinion that the issue is substantially narrowed down. It<br \/>\ncannot be stated that respondent no.3 is an encroacher over the land<br \/>\nin question. In any case, whether action should be initiated under<br \/>\nthe provisions of Prevention of Antisocial Activities Act or not must<br \/>\ndepend on facts and circumstances of a case and it is within the<br \/>\npower subjective satisfaction of the Competent Authority whether such<br \/>\nan action should be initiated or not. I do not see how the present<br \/>\npetitioner as a citizen can insist that action must be taken by the<br \/>\nGovernment under the Prevention of Antisocial Activities Act,<br \/>\nparticularly when no direct injury or injustice to her is shown.\n<\/p>\n<p>\tIn<br \/>\nthe result, the petition fails and the same stands dismissed. Rule is<br \/>\ndischarged.
