VARIAVA, J.\n<\/p>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>Leave granted.\n<\/p>\n<p>Heard parties.\n<\/p>\n<p>    This  Appeal  is  against an Order dated  18th  January,<br \/>\n2000.  Breifly stated that facts are as follows :\n<\/p>\n<p>    Respondent\tNo.  1 was employed by the Appellant Bank as<br \/>\na  Samiti  Sevak.  A show cause notice was issued to him  to<br \/>\nexplain certain financial irregularities and embezzlement of<br \/>\nmonies\tby  not depositing loan amounts recovered  from\t the<br \/>\nmembers.  On receipt of the show cause notice Respondent No.<br \/>\n1  made good to the Bank the amounts.  Respondent No.  1 did<br \/>\nnot  reply  to\tthe  show cause\t notice.   Services  of\t the<br \/>\nRespondent  No.\t  1  were,  therefore,\tterminated  on\t10th<br \/>\nAugust,\t 1977.\tRespondent No.\t1 filed a suit under Section<br \/>\n55(2)  of  the\tMadhya Pradesh Co-operative  Societies\tAct,<br \/>\n1960,  for setting aside the order of dismissal.  Respondent<br \/>\nNo.   1\t claimed  the reinstatement with  back\twages.\t The<br \/>\nAssistant Registrar held on evidence that the Respondent No.<br \/>\n1 was guilty of the conduct alleged.  However, the Assistant<br \/>\nRegistrar  noted  that\tthere  had been\t no  inquiry  before<br \/>\nservices were terminated.  The Assistant Registrar therefore<br \/>\ndeclared the dismissal as illegal and directed reinstatement<br \/>\nbut  without  back wages.  On Appeal by the  Appellants\t the<br \/>\norder of reinstatement without back wages was maintained.\n<\/p>\n<p>    On\tfurther\t Appeal to the Board of Revenue it was\theld<br \/>\nthat  the Respondent No.  1 was entitled to back wages.\t The<br \/>\nWrit  Petition filed by the Appellants was dismissed by\t the<br \/>\nimpugned  order dated 18th January, 2000.  It was held\tthat<br \/>\nonce  it  was held that services were terminated  unlawfully<br \/>\nthen  as  a  necessary\tconsequence the\t employee  would  be<br \/>\nentitled to back wages.\n<\/p>\n<p>    In\tour view the Order passed by the Assistant Registrar<br \/>\nwas correct.  On facts it had been found that the Respondent<br \/>\nNo.   1\t had  embezzled\t certain monies.   The\tmonies\twere<br \/>\nreturned  by him only after the show cause notice was issued<br \/>\nto  him.   His termination was set aside only  on  technical<br \/>\ngrounds\t inasmuch  as no inquiry was conducted.\t Under\tsuch<br \/>\ncircumstances  the  Assistant  Registrar correctly  did\t not<br \/>\naward  any back wages.\tIn our view, on facts of this  case,<br \/>\nthe  order  directing  payment\tof   back  wages  cannot  be<br \/>\nsustained.\n<\/p>\n<p>    Accordingly\t we maintain the order of reinstatement\t but<br \/>\nset aside that portion of the Order which directs payment of<br \/>\nback wages.\n<\/p>\n<p>    The\t Appeal stands disposed of accordingly.\t There shall<br \/>\nbe no Order as to costs.\n<\/p>\n<p>(D.P.
