SHAH\n\t\t\n\t\n\n \n\nDate\n: 29\/07\/2010 \n\n \n\nCOMMON\nORAL JUDGMENT<\/pre>\n<p>\tRule.\n<\/p>\n<p> Learned Assistant Government<br \/>\nPleaders in respective petitions<br \/>\nwaives service of notice of<br \/>\nRule on behalf of respondent   State.\n<\/p>\n<p>1.\tAs<br \/>\nthis Court proposes to remand the matter to the Secretary (Appeals),<br \/>\nRevenue Department, State of Gujarat to decide and dispose of the<br \/>\nRevision Application Nos.1\/2008 to 9\/2008 and Revision Application<br \/>\nNo.15\/2008, as only those orders are challenged in the present<br \/>\nSpecial Civil Applications, the private respondents are not required<br \/>\nto be heard and as the impugned orders are passed by the Secretary<br \/>\n(Appeals), Revenue Department, State of Gujarat in suo<br \/>\nmotu Revision<br \/>\nApplications, only State is required to be heard and that is how<br \/>\nlearned Assistant Government Pleaders are heard.\n<\/p>\n<p>2.\tIn<br \/>\nall these petitions, respective common petitioner (original owner)<br \/>\nhas prayed for an appropriate writ, direction or order quashing and<br \/>\nsetting aside the impugned judgment and order dated 15.01.2010 passed<br \/>\nby the Secretary (Appeals), Revenue Department, State of Gujarat in<br \/>\nRevision Application Nos.1\/2008 to 9\/2008 and Revision Application<br \/>\nNo.15\/2008, by which the Secretary (Appeals), Revenue Department,<br \/>\nState of Gujarat in exercise of the powers under Section 211 of the<br \/>\nBombay Land Revenue Code has quashed and set aside the respective<br \/>\norders passed by the Taluka Development Officer mentioned in<br \/>\nparagraph 6 of the said order, by which the Taluka Development<br \/>\nOfficer, Vadodara quashed and set aside the non-agriculture use<br \/>\npermission granted in favour of original owner and\/or respective<br \/>\npersons and imposing 10 times (pet) penalty.  The main grievance of<br \/>\nthe petitioner is that though the petitioner is the owner of the<br \/>\ndisputed lands in question, petitioner is not heard and therefore,<br \/>\nthe impugned orders passed by the respondent   State of Gujarat is<br \/>\nin breach of principles of natural justices.\n<\/p>\n<p>3.\tHaving<br \/>\nheard learned advocates appearing for respective parties and<br \/>\nconsidering the above submissions, this Court is of the opinion that<br \/>\nbeing an owner, petitioner ought to have been given an opportunity.<br \/>\nUnder the circumstances, impugned orders passed by the Revisional<br \/>\nAuthority passed in aforesaid Revision Application Nos.1\/2008 to<br \/>\n9\/2008 and Revision Application No.15\/2008 deserves to be quashed and<br \/>\nset aside and the matters are to be remanded to the Secretary<br \/>\n(Appeals), Revenue Department, State of Gujarat for deciding the same<br \/>\nafresh in accordance with law and on merits and after giving an<br \/>\nopportunity to petitioner and all other concerned.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and for the reasons stated above, without further<br \/>\nentering into merits of the case and\/or expressing anything on<br \/>\nmerits, impugned order dated 15.01.2010 passed by the<br \/>\nSecretary(Appeals), Revenue Department, State of Gujarat in suo<br \/>\nmoto Revision Application Nos.1\/2008 to 9\/2008 and Revision<br \/>\nApplication No.15\/2008 are hereby quashed and set aside and the<br \/>\nmatter is remanded to the Secretary (Appeals), Revenue Department,<br \/>\nState of Gujarat to decide and dispose of the same and pass an<br \/>\nappropriate order in accordance with law and on merits and after<br \/>\ngiving an opportunity to the petitioner and all concerned.  Let the<br \/>\npetitioner submit an appropriate application before the Revisional<br \/>\nAuthority in the aforesaid proceedings for permitting him to be<br \/>\njoined as party, within a period of three weeks from today and<br \/>\nRevisional Authority is hereby directed to permit the applicant to be<br \/>\njoined as party respondent in the aforesaid Revision Application<br \/>\nNos.1\/2008 to 9\/2008 and Revision Application No.15\/2008 and pass an<br \/>\nappropriate order in accordance with law and on merits after giving<br \/>\nan opportunity of hearing to the petitioner as well as all other<br \/>\nconcerned.  The aforesaid exercise shall be completed within a period<br \/>\nof four months from the date of receipt of the present order.  Rule<br \/>\nis made absolute in each of the petitions to the aforesaid extent<br \/>\nonly.  In the facts and circumstances of the case, no order as to<br \/>\ncosts.
