M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe have<br \/>\nheard Mr. K.M. Patel, learned Sr. Advocate with Mr. Mukesh H. Rathod<br \/>\nand Mr. G.K. Rathod, learned Counsel for the applicants and Mr. H.S.<br \/>\nMunshaw, learned Counsel for the respondent. Mr. Munshaw, is allowed<br \/>\nthree weeks time from today to file affidavit-in-reply and Mr. Mukesh<br \/>\nH.  Rathod, is allowed two weeks time, thereafter, to file<br \/>\nrejoinder.\n<\/p>\n<p>2.\t\tLearned<br \/>\nCounsel for the appellants \/ applicants submitted that there was no<br \/>\nfoundation laid in Special Civil Application that the list of<br \/>\nemployees, filed as Exhibit-40, which shows appellant was employee of<br \/>\nthe respondents for the years 1994, 1995 and 1996 was incorrect. The<br \/>\nsaid list was not disputed by the respondents either before the<br \/>\nlabour Court nor there was any pleading before the learned Single<br \/>\nJudge in Special Civil Application that the said list was of the<br \/>\nvolunteers, for the years 1994, 1995 and 1996. Since, this fact was<br \/>\nnot pleaded, it appears that the respondent had accepted the list to<br \/>\nbe of the employees for the years 1994, 1995 and 1996. Exhibit-40,<br \/>\nthe own document of the respondent established that the applicants<br \/>\nhave worked for three years i.e. 1994, 1995 and 1996, as employees of<br \/>\nthe respondent, as their<br \/>\nnames find mention in the list of employees. In  absence of any<br \/>\npleading that the list of employees mentioned in Exhibit-40 was<br \/>\nillegal,  nor there was any relief claimed that Exhibit-40 was<br \/>\nillegal and it ought not to have been relied by the labour Court, the<br \/>\nlearned Single Judge could not have held the list to be illegal.  The<br \/>\nApex Court, in the case of &#8220;Manohar Lal(Dead)<br \/>\nBy LRS. Vs. Ugrasen (Dead) By LRS. And Others&#8221;,<br \/>\nreported in (2010) 11 SCC 557,  held that in<br \/>\nabsence of any pleading, no relief can be granted.\n<\/p>\n<p>3.\t\tIn view<br \/>\nof the aforesaid undisputed facts, prima faice, we are of the<br \/>\nopinion that the learned Single Judge committed an error in<br \/>\ndiscarding the list of employees, Exhibit-40, which was the very<br \/>\nbasis of the order of the Labour Court, in granting relief of<br \/>\nreinstatement to the appellants\/applicants. The list Exhibit-40 was<br \/>\nnot challenged by the respondent before the learned Single Judge but<br \/>\nhe has harped upon the validity of the said list, without there being<br \/>\nany whisper or foundation laid in the writ petition.\n<\/p>\n<p>4.\t\tFor the<br \/>\naforesaid reasons, the applicants are entitled to interim relief.\n<\/p>\n<p>5.\t\tUntil<br \/>\nfurther order of this Court, the effective operation of the order of<br \/>\nthe learned Single Judge, dated 20th October, 2010, shall<br \/>\nremain stayed.\n<\/p>\n<p>(V.\n<\/p>\n<p>M.
