    Petitioner the accused, in C.C.1003\/2009<\/p>\n
now pending as L.P.79\/2010 on the file of<\/p>\n
Judicial   First   Class   Magistrate    Court,<\/p>\n
Kodungallur, filed this petition challenging<\/p>\n
Annexure III order passed by the        learned<\/p>\n
Magistrate dismissing his    application filed<\/p>\n
under  section   205   of  Code   of   Criminal<\/p>\n
Procedure.\n<\/p>\n
    2.    Learned  counsel  appearing  for  the<\/p>\n
petitioner was heard.\n<\/p>\n
    3.  The argument of the learned counsel is<\/p>\n
that the offence alleged against the petitioner<\/p>\n
is  only  under   section  138  of   Negotiable<\/p>\n
Instruments Act and as held by this court<\/p>\n
presence of the petitioner is to be dispensed<\/p>\n
with during trial and the learned Magistrate is<\/p>\n
Crl.M.C.4366\/2010            2<\/span><\/p>\n
not justified in dismissing the application on the<\/p>\n
ground that case is included in the long pending<\/p>\n
register.\n<\/p>\n
      4.     Annexure II is the application filed under<\/p>\n
section 205 of Code of Criminal Procedure before<\/p>\n
the learned Magistrate.      That application was filed<\/p>\n
not by the party, but for the accused by the<\/p>\n
counsel.       When presence of the petitioner is to be<\/p>\n
dispensed with during trial, it is for him to apply<\/p>\n
stating that if permission is granted, on his<\/p>\n
behalf his counsel will appear and evidence could<\/p>\n
be recorded in his       absence   treating presence of<\/p>\n
the counsel       as his presence,  undertaking that he<\/p>\n
will not challenge the evidence so recorded either<\/p>\n
before that court or in appeal or revision and he<\/p>\n
will not dispute the identity.       As the application<\/p>\n
is not filed by the party, I do not find any reason<\/p>\n
to interfere with Annexure III order.      Annexure III<\/p>\n
will not stand in the way of the petitioner to file<\/p>\n
a proper application before the learned Magistrate<\/p>\n
in accordance with law.\n<\/p>\n
