Heard Counsel for the petitioners and the A.P.P.<\/p>\n<p>                      appearing on behalf of the State. Nobody appears on behalf<\/p>\n<p>                      of the Opposite Party No. 2 to pursue this matter.<\/p>\n<p>                      2.       The petitioner Sidharth @ Sidharth Kumar Jha is<\/p>\n<p>                      the Branch Head of Karvy Stock Broking Ltd. at Begusarai<\/p>\n<p>                      whereas petitioner Santosh Kumar is the Dealer of Karvy<\/p>\n<p>                      Stock Broking Ltd. at Begusarai. The petitioners Abhinav<\/p>\n<p>                      Prasad @ Abhinav is the Regional Manager, Himanshu<\/p>\n<p>                      Joshi is the Divisional Manager, Nitin Saxena is the Vice<\/p>\n<p>                      President, whereas Nalini Tilak is the Divisional Staff of<\/p>\n<p>                      Karvy Stock Broking Ltd. The petitioners of Criminal Misc.<\/p>\n<p>                      No. 36367 of 2006 are working and living in the State of<\/p>\n<p>                      Uttar Pradesh and have no connection directly with the<\/p>\n<p>                      affairs in the Begusarai Branch.\n<\/p>\n<p>                      3.      The allegations in the complaint petition are that<\/p>\n<p>                      the complainant Dilip Kumar Mishra had deposited by<\/p>\n<p>                      various cheques a sum of Rs. 1.6 lakhs for the purpose of<\/p>\n<p>                      buying shares. It is the case of the complainant that he<\/p>\n<p>                      had instructed the petitioner Santosh Kumar to trade in<\/p>\n<p>                      shares. It is admitted on behalf of the complainant that he<\/p>\n<p>                      did not have a trading account in his name till 10.01.2006<\/p>\n<p>                      with the Karvy Stock Broking Ltd. He only had a Demat<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>Account. As such, the trading took place in the name of<\/p>\n<p>one Annu Kumar. It is alleged that the company has<\/p>\n<p>caused loss to the complainant and has also caused<\/p>\n<p>mental harassment. This complaint case was filed on<\/p>\n<p>05.04.2006.\n<\/p>\n<p>4.    The complainant had also filed Consumer Complaint<\/p>\n<p>Case No. 21 of 2006 before the District Consumer Forum,<\/p>\n<p>Begusarai     on       01.04.2006.   This   fact   has   not   been<\/p>\n<p>mentioned in the complaint petition. During the pendency<\/p>\n<p>of this case, the Consumer Court has disposed of the<\/p>\n<p>complaint by dismissing it. While disposing of the case, the<\/p>\n<p>facts as narrated in the complaint petition have been<\/p>\n<p>mentioned. Besides which, the Consumer Court had the<\/p>\n<p>opportunity to examine the accounts and the receipts<\/p>\n<p>granted by Karvy Stock Broking Ltd. It has been recorded<\/p>\n<p>by the Consumer Court that all the receipts were granted<\/p>\n<p>in the name of Annu Kumar and that the trading license of<\/p>\n<p>Annu Kumar was utilized for trading in the stock market<\/p>\n<p>with the money that was deposited with the company i.e. a<\/p>\n<p>sum of Rs. 1.6 lakhs. It has been noted by the Consumer<\/p>\n<p>Court that Annu Kumar has not been made party in the<\/p>\n<p>case filed before the District Consumer Forum.                 Only<\/p>\n<p>Annu Kumar who can certify to the facts with respect to<\/p>\n<p>the utilization of his trading license and the money by the<\/p>\n<p>Company. It is admitted that the complainant did not have<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>                    trading license and, therefore, no stocks could have been<\/p>\n<p>                    purchased and sold by the Company for the complainant.<\/p>\n<p>                    5.           Considering these facts and findings of the<\/p>\n<p>                    Consumer Court, it is obvious that no offence would have<\/p>\n<p>                    made out against the petitioners as the petitioners had not<\/p>\n<p>                    utilized the trading account of the complainant\/Opposite<\/p>\n<p>                    Party No. 2 for the purpose of buying or selling stocks and<\/p>\n<p>                    as such, there could not have been any loss incurred to<\/p>\n<p>                    the complainant.\n<\/p>\n<p>                    6.           Considering the aforesaid facts, this Court find<\/p>\n<p>                    that in fact the ingredients of Section 327, 406, 420 and<\/p>\n<p>                    504\/34 of the Indian Penal Code would not be attracted in<\/p>\n<p>                    the facts of this case as the complainant did not have the<\/p>\n<p>                    trading license for stocks with the Karvy Stock Broking<\/p>\n<p>                    Ltd., where the petitioners are posted on various posts.<\/p>\n<p>                    7.           In the circumstances, I quash the order dated<\/p>\n<p>                    20.05.2006 passed in Complaint Case No. 551 C of 2006<\/p>\n<p>                    pending   before     the   Judicial   Magistrate,   1st   Class,<\/p>\n<p>                    Begusarai.\n<\/p>\n<p>                    8.
