Justice HARUN-UL-RASHID\n\n Dated :18\/02\/2009\n\n O R D E R\n                       HARUN-UL-RASHID,J.\n                ---------------------------\n                C.R.P.NOS.707, 949 OF 2006 &amp;\n                        300 &amp; 466 OF 2007\n                ----------------------------\n           DATED THIS THE 18TH DAY OF FEBRUARY, 2009\n\n                             O R D E R\n<\/pre>\n<p>     These revision Petitions are filed against the order in the<\/p>\n<p>Ele.O.Ps. filed for claiming compensation. The revision petitioner<\/p>\n<p>in these revisions relying on the decision reported in K.S.E.B. vs.<\/p>\n<p>Livisha, 2007(3) K.L.T. 1(SC) requests this Court to redetermine<\/p>\n<p>the compensation in accordance with the principles laid down in<\/p>\n<p>the   said decision.    In paragraphs 11 and 12       of the above<\/p>\n<p>judgment, the Supreme Court held as follows:\n<\/p>\n<blockquote><p>                 &#8220;11. So far as the compensation in<br \/>\n           relation to fruit bearing trees are concerned,<br \/>\n           the same would also depend upon the facts<br \/>\n           and circumstances of each case.<\/p><\/blockquote>\n<p>                 12. We may, incidentally, refer to a<br \/>\n           recent decision of this      Court in <a href=\"\/doc\/1121206\/\">Land<br \/>\n           Acquisition Officer, A.P. v. Kamandana<br \/>\n           Ramakrishna Rao &amp; Anr.<\/a> reported in<br \/>\n           2007 AIR SCW 1145 wherein claim on<br \/>\n           yield basis has been held to be relevant for<br \/>\n           determining the amount of compensation<\/p>\n<p><span class=\"hidden_text\">                                -2-<\/span><br \/>\nC.R.P.Nos.707\/06 &amp;<br \/>\nconnected cases.\n<\/p>\n<p>            payable under the Land Acquisition Act,<br \/>\n            same principle has been reiterated in<br \/>\n            Kapur Singh Mistry v. Financial<br \/>\n            Commission &amp; Revenue Secretary to<br \/>\n            Govt. of Punjab &amp; Ors. 1995 Supp.(2)<br \/>\n            SCC     635,    State    of  Haryana      v.\n<\/p>\n<p>            Gurucharan Singh &amp; Anr. (1995 Supp.\n<\/p>\n<p>            (2) SCC 637) para 4          and <a href=\"\/doc\/1733977\/\">Airports<br \/>\n            Authority of India v. Satyagopal Roy &amp;<br \/>\n            Ors.<\/a>(2002) 3 SCC 527.          In Airport<br \/>\n            Authority (supra), it was held:-\n<\/p>\n<p>                  &#8220;14. Hence, in our view, there was<br \/>\n            no reason for the High Court not to follow<br \/>\n            the decision rendered by this Court in<br \/>\n            Gurucharan Singh&#8217;s case and determine<br \/>\n            the   compensation       payable   to    the<br \/>\n            respondents on the basis of the yield from<br \/>\n            the trees by applying 8 years&#8217; multiplier.<br \/>\n            In this view of the matter, in our view, the<br \/>\n            High Court committed error apparent in<br \/>\n            awarding    compensation     adopting    the<br \/>\n            multiplier of 18.&#8217; &#8221;\n<\/p>\n<p>     2.    The learned Standing Counsel for the K.S.E.B.\n<\/p>\n<p>submitted that the matter requires reconsideration on the basis of<\/p>\n<p>the Supreme Court decision           and requested to afford an<\/p>\n<p>opportunity to adduce additional evidence to substantiate their<\/p>\n<p>contentions in the light of the said Supreme Court decision.\n<\/p>\n<p><span class=\"hidden_text\">                                -3-<\/span><\/p>\n<p>C.R.P.Nos.707\/06 &amp;<br \/>\nconnected cases.\n<\/p>\n<p>     3. In the light of the said decision of the Supreme Court,<\/p>\n<p>the matter has to be reconsidered by the court below and an<\/p>\n<p>opportunity has to be given to both sides to adduce evidence to<\/p>\n<p>establish proper compensation        payable in the case and<\/p>\n<p>determination of the said fact is necessitated on the basis of the<\/p>\n<p>principles laid down by the Supreme Court.\n<\/p>\n<p>     4.
