MITTAL\n\nPresent:-    Mr. Saurabh Bajaj, Advocate\n             for the petitioner.\n                   -----\nORDER:\n<\/pre>\n<p>             This petition seeks quashing of letter dated 21.8.2008,<\/p>\n<p>Annexure P-5, requiring the petitioner to show cause why his licence be<\/p>\n<p>not cancelled under Section 36(c) of the Punjab Excise Act, 1914 and<\/p>\n<p>why the amount of security for unexpired period of the licence be not<\/p>\n<p>forfeited.\n<\/p>\n<p>             The allegation in the notice is that the petitioner had opened<\/p>\n<p>sub-Vend in less than 2.5 kms. from L-14A Vend at Hansi Road No.II<\/p>\n<p>and thereby, contravened condition No.2.6 of the Excise Policy for the<\/p>\n<p>year 2008-09.\n<\/p>\n<p>             Case of the petitioner is that there was no violation of the<\/p>\n<p>same, as requirement of Rule 2.6 of the policy was applicable only to<\/p>\n<p>rural vends, while the petitioner had licence in the urban area.<\/p>\n<p>             We find two difficulties in entertaining this petition. The<\/p>\n<p>petitioner had earlier filed C.W.P. No.15304 of 2008 for almost identical<\/p>\n<p>relief i.e. against sealing of the sub-Vend on the same ground. The<\/p>\n<p>petitioner was required to show any sanction for the sub-Vend, on<br \/>\n C.W.P. No.19699 of 2008<\/p>\n<p><span class=\"hidden_text\">                                                                             2<\/span><\/p>\n<p>which the petitioner withdrew the writ petition. Order dated 5.9.2008 is<\/p>\n<p>as under:-\n<\/p>\n<blockquote><p>                   &#8220;On 29.8.2008, following order was passed:-\n<\/p><\/blockquote>\n<blockquote><p>                        &#8220;Learned counsel for the petitioner seeks time to<br \/>\n                   show the sanction alleged to have been granted for<br \/>\n                   opening Sub Vend in the area of Hakikat Nagar.\n<\/p><\/blockquote>\n<blockquote><p>                         List again on 5.9.2008.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                         Learned counsel for the petitioner is unable to<br \/>\n                   show any sanction having been granted for opening of<br \/>\n                   Sub Vend.\n<\/p><\/blockquote>\n<blockquote><p>                         We, thus, do not find any merit in this petition.<br \/>\n                         Learned counsel for the petitioner says that he<br \/>\n                   is going to file another petition against some other<br \/>\n                   letter received.\n<\/p><\/blockquote>\n<blockquote><p>                         We do not express any opinion on the said<br \/>\n                   course of action.\n<\/p><\/blockquote>\n<blockquote><p>                         At this stage, learned counsel for the petitioner<br \/>\n                   says that the petition be dismissed as withdrawn.\n<\/p><\/blockquote>\n<blockquote><p>                         Dismissed as withdrawn.<\/p><\/blockquote>\n<p>             Apart from above, the impugned letter was merely a notice,<\/p>\n<p>requiring the petitioner to show cause why action be not taken and the<\/p>\n<p>petitioner has not chosen to take alternative remedy of responding to<\/p>\n<p>the said letter.\n<\/p>\n<p>             In view of above, this petition is dismissed, without prejudice<\/p>\n<p>to the petitioner replying to the impugned notice and decision being<\/p>\n<p>taken by the appropriate authority in accordance with law.<\/p>\n<pre>\n\n                                             ( ADARSH KUMAR GOEL )\n                                                    JUDGE\n\n\nNovember 19, 2008                                   ( L.
