REV. No.125 of 2011 (4) dt.27-06-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                2\/2<\/span><\/p>\n<p>                   filing the Civil Review Application is condoned.\n<\/p><\/blockquote>\n<blockquote><p>                                    Interlocutory Application stands disposed of.<br \/>\n                   Civil Review No. 125 of 2011:\n<\/p><\/blockquote>\n<blockquote><p>                                    This application for review of our order dated 1st<br \/>\n                   December 2010 made on above Letters Patent Appeal No.1420 of<br \/>\n                   2010 is filed by the appellant.\n<\/p><\/blockquote>\n<blockquote><p>                                    Learned Advocate Mr. Ashok Kumar Jha has<br \/>\n                   appeared for the appellant. He has submitted that though the entire<br \/>\n                   order is in favour of the appellant, the lines, &#8220;Further the<br \/>\n                   appellant cannot be granted permit with retrospective effect<br \/>\n                   from 2005. In view of passage of time the cause of action has<br \/>\n                   become infructuous&#8221;, are being interpreted by the respondent<br \/>\n                   authorities so as to refuse the renewal of transport permit in terms<br \/>\n                   of Section 81(5) of the Motor Vehicles Act, 1988.\n<\/p><\/blockquote>\n<blockquote><p>                                    On the facts and in the circumstances of the case, the<br \/>\n                   aforesaid lines, though are not meant to circumscribe the powers<br \/>\n                   of the respondent authority to renew the permit in accordance with<br \/>\n                   Section 81(5) of the Motor Vehicles Act, 1988, with a view to<br \/>\n                   removing doubt, are ordered to be deleted from our order dated 1st<br \/>\n                   December 2010.\n<\/p><\/blockquote>\n<blockquote><p>                                    The Review Application stands allowed in the above<br \/>\n                   terms. Our order dated 1st December 2010 will stand corrected to<br \/>\n                   the aforesaid extent.<\/p><\/blockquote>\n<p>                                                  (R.M.
