PATTANAIK (J)\n\nCITATION:\n 1996 SCC  (4) 697\t  JT 1996 (5)\t272\n 1996 SCALE  (4)332\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have  heard learned  counsel  on  both\tsides.\tThis<br \/>\nappeal by  special leave  arises from the judgment and order<br \/>\ndated 24.7.1995 made in L.P.A. No.10\/93 of the High Court of<br \/>\nGuwahati.  The\t admitted  facts   are\tthat   the  property<br \/>\noriginally belonged  to one  Syed Md.  Mahibullah After\t his<br \/>\ndemise, the  property passed  on to his widow five daughters<br \/>\nand five  sons.\t  His widow  died in  1971. Subsequently, it<br \/>\nwould appear that the sisters have relinquished their rights<br \/>\nin the\tproperties in  favour of  their five brothers. It is<br \/>\nthe case  of the appellant that at a family settlement among<br \/>\nthe brothers  on December  6, 1977,  the suit  property\t was<br \/>\nallotted to  Syed Baitul Alam who had sold the said property<br \/>\nunder registered  sale deed  to the  appellant on  August 6,<br \/>\n1979. He  laid the suit for declaration of his title and for<br \/>\nejectment of  the respondent.  The trial  Court decreed\t the<br \/>\nsuit. On  first appeal,\t the learned  single Judge confirmed<br \/>\nthe decree.  The Division Bench in the above L.P.A. reversed<br \/>\nthe decree  and dismissed  the suit. The Division Bench came<br \/>\nto the\tconclusion that relinquishment of the property would<br \/>\noperate as  a gift by the sisters and delivery of possession<br \/>\nis a  pre-condition. Since  possession was  not delivered to<br \/>\nthe brothers,  the gift\t by the sisters is not valid in law.<br \/>\nAs regards  the family\tsettlement between the brothers, the<br \/>\nDivision Bench\thas held  that since  there  is\t no  dispute<br \/>\npending or  prospective, between  the brothers,\t the  family<br \/>\nsettlement  is\t not  valid   in  law  and,  therefore,\t the<br \/>\nappellants cannot  derive any title from one of the brothers<br \/>\nto whom\t the property  had fallen  to his  share through the<br \/>\nsaid settlement. Consequently, the sale to the appellants on<br \/>\nAugust 6,  1979 is not also valid. On that premise, the suit<br \/>\ncame to be dismissed.\n<\/p>\n<p>     It is  contended by  Mr. P.K.  Goswami, learned  Senior<br \/>\ncounsel\t appearing   for  the  respondents,  that  from\t the<br \/>\nevidence it  is clear even assuming that the dispute between<br \/>\nthe brothers  has not  been properly  existing, since one of<br \/>\nthe brothers  who is  admittedly staying  in London  did not<br \/>\nparticipate to settle the dispute and even in the plaint his<br \/>\naddress was  of Guwahati  while he was staying in London, it<br \/>\nis not a bona fide settlement. It is also contended that the<br \/>\nsisters\t  having not delivered possession of the property to<br \/>\nthe brothers  under  the  personal  law,  the  gift  is\t not<br \/>\ncomplete. Therefore,  the appellant  cannot  get  any  valid<br \/>\ntitle. Since  the respondent have not acknowledged the title<br \/>\nof the appellants, there is no estoppel under section 116 of<br \/>\nthe Indian  Evidence Act. Since the appellant get derived no<br \/>\ntitle it  would be  open to  the respondent  to\t assail\t the<br \/>\nvalidity of  the sale.\tThe High Court, therefore, was right<br \/>\nin dismissing the suit.\n<\/p>\n<p>     Having regard  to the  contention the  question arises:<br \/>\nwhether the  High Court\t was correct in law in upsetting the<br \/>\njudgment of  the learned single Judge and the trial Court in<br \/>\ndismissing the\tsuit? It  is true  that there  is no  actual<br \/>\ndelivery of the possession pursuant to the gift said to have<br \/>\nbeen made  by five  sisters in\tfavour or five brothers. The<br \/>\nproperty admittedly  belonged to  father Syed Md. Mahibullah<br \/>\nwho died  in 1954.  Thereby all\t the  brothers\tand  sisters<br \/>\nbecome owners  to  the\textent\tof  their  shares  they\t had<br \/>\nsucceeded to  the property.  Thus all of them are co-owners.<br \/>\nIt would be open to the sisters to relinquish their right by<br \/>\nway of\tgift, even  oral, which\t is valid  in personal\tlaw.<br \/>\nSince the  tenant  has\tbeen  in  occupation,  it  would  be<br \/>\nconstructive delivery  of the  possession. Delivery  of\t the<br \/>\nphysical possession  to the  brothers, in the circumstances,<br \/>\nis not\twarranted.   As regards the family settlement of the<br \/>\nbrothers, it  would open  to the  brothers  to\tresolve\t the<br \/>\nprospective  dispute   by  way\tof  family  settlement.\t The<br \/>\nbrothers having\t agreed for the settlement, though they have<br \/>\nbeen impleaded\tas party-respondents  to the suit, they have<br \/>\nnot challenged the family settlement nor have they contested<br \/>\nthe  validity\tthereof.  It   is  not\t necessary,  in\t the<br \/>\ncircumstances, that  all the  brothers\tbe  present  at\t the<br \/>\nsettlement.  One  of  the  brothers  living  in\t London\t can<br \/>\nauthorize his  other brothers  to settle  the dispute and he<br \/>\nwas a  consenting party to it. Under those circumstances, we<br \/>\nare of the view that the brothers obviously had a settlement<br \/>\npursuant to  which the demised property has been allotted to<br \/>\nthe share  of Syed  Baitul Alam who had sold the property to<br \/>\nthe appellant  under the sale deed dated August 6, 1979. The<br \/>\nsale   deed   is   a   registered   conveyance\t for   valid<br \/>\nconsideration. Under  those circumstances,  by operation  of<br \/>\nsection 17 of the Registration Act, the appellant gets valid<br \/>\ntitle to  the property.\t The pre-existing  right, title\t and<br \/>\ninterest in  the  property  of\tSyed  Baitul  Alam  and\t his<br \/>\nbrothers  stood\t  extinguished\tby  operation  of  the\tlaw.<br \/>\nThereby, the  appellants get  valid title  to the  property.<br \/>\nSince the  respondent was continuing as a tenant, obviously,<br \/>\nhe is  bound by\t the title  since the suit has been laid for<br \/>\neviction of  the respondent  and  decree  for  eviction\t was<br \/>\nrightly granted.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed. The  order of\t the<br \/>\nDivision Bench\tis set\taside and  the order  of the learned<br \/>\nsingle Judge  stands restored. Six months time from today is<br \/>\ngranted to  the respondents to vacate the premises on filing<br \/>\nusual undertaking within four weeks from today.
