Heard learned counsels.\n\n\n\n2.    This writ petition has been filed by the defendant, L.Rs of Jetha\n\nRam, challenging the impugned order dated 19\/1\/2009, whereby, the\n\nlearned trial court rejected the application of the defendant under\n\nOrder 16 Rule 1(3) CPC for summoning the two witnesses during the\n\ncourse of the defendant's evidence, (i) Dr.Keshav Kotwani and (ii)\n\nCollector (Stamps). Said application was filed by the defendants on\n\nthe ground that Jetha Ram executed the sale deed in favour of the\n\nplaintiff under the influence of opium and he was being treated by\n\nDr.Keshav Kotwani and, therefore, even though list of witnesses filed\n\nby the defendants did not include the name of these two witnesses,\n\nthey were required to be summoned by the learned trial court in\n\nsupport of defence evidence. The other witness namely Collector\n                                            S.B.CIVIL WRIT PETITION NO.1034\/2009\n                                              LRrs of Jetha Ram vs. Nain Singh &amp; Ors.\n                                                      DATE OF ORDER : 29\/10\/2009\n\n\n                                   2\/6\n\n(Stamps) was sought to be summoned on the ground that the said\n\nauthority had held an inquiry into the execution of the sale deed in\n\nquestion and, therefore, summoning of that authority was also\n\nnecessary.\n\n\n\n3.    Learned trial court rejected the said application inter alia on\n\ntwo grounds; (i) that names of these two witnesses was not included\n\nin the list of witnesses and (ii) said application was belatedly filed\n\nwhen the plaintiff evidence was already over and to delay the trial,\n\nthe defendants have moved this application, which was liable to be\n\nrejected at the cost of Rs.300\/-. Being aggrieved of the said order, the\n\ndefendant have approached this Court by way of present writ petition.\n\n\n\n4.    Mr. C.S.Kotwani, learned counsel for the defendant petitioners\n\nsubmitted that Order 16 Rule 1 (3) CPC permits the trial court, for\n\nreasons to be recorded, to call or summon witness even though such\n\nwitness do not figure in the list of witnesses filed by the party, if such\n\nparty shows sufficient cause for omission to mention the name of\n\nsuch witness in the said list. He submitted that, relying upon the\n\nvarious decisions of different High Courts including this Court, that\n                                          S.B.CIVIL WRIT PETITION NO.1034\/2009\n                                            LRrs of Jetha Ram vs. Nain Singh &amp; Ors.\n                                                    DATE OF ORDER : 29\/10\/2009\n\n\n                                  3\/6\n\nthe provisions of Order 16 Rule 1 (3) CPC are directory in nature,\n\ntherefore, in the interest of justice said witnesses can be summoned\n\nby the learned trial court even though their names were not included\n\nin the list of witnesses filed by the defendants. On the side opposite, Mr. Amit Mehta, learned counsel\n\nappearing for the respondent plaintiff submitted that requirement of\n\nOrder 16 Rule 1 (1) CPC for furnishing the list of witnesses is\n\nmandatory in nature and, therefore, it cannot be easily be waived or\n\ndispensed with. Moreover, in order to delay the trial the defendants\n\nmoved the said application in the suit filed in 2000, when the\n\nplaintiff's evidence was closed on 6\/12\/2008 and defendants' evidence\n\nwas to start in the year 2009. He urged that it was open for the\n\ndefendants to produce these witnesses as his own witnesses. Order\n\n16 Rule 1A CPC permits such witnesses to be produced even though\n\ntheir names are not included in the list of witnesses. He, therefore,\n\nsubmitted that application filed by the defendant under Order 16 Rule\n\n1 (3) CPC was misconceived and has been rightly rejected by the trial\n\ncourt with cost.\n\n\n\n6.    Having heard learned counsels and upon perusal of the record\n\nof the case and reasons given in the impugned order, this court is\n\nsatisfied that the learned trial court has not committed any error in\n\nrejecting the application filed by the defendant petitioner under Order\n\n16 Rule 1 (3) CPC.\n                                            S.B.CIVIL WRIT PETITION NO.1034\/2009\n                                              LRrs of Jetha Ram vs. Nain Singh &amp; Ors.\n                                                      DATE OF ORDER : 29\/10\/2009\n\n\n                                   5\/6\n\n\n\n\n7.    It is true that provisions of Order 16 Rule 1 (3) are directory in\n\nnature and permit the trial court to summon such witnesses, whose\n\nnames are not included in the list of witnesses and in the interest of\n\njustice, if the Court is of the opinion that summoning of such\n\nwitnesses is necessary. It is equally true that what is permitted to the\n\ntrial court is what it can do but does not mandate at the same time to\n\nlearned trial court that it should do a particular thing. It is absolutely\n\nwithin the discretion of the learned trial court to assign reasons, either\n\nfor summoning such witnesses or for refusing to summon such\n\nwitnesses. In the present case, Dr. Keshav Kotwani, who was sought\n\nto be summoned on the ground that he was treating the said Jetha\n\nRam for his opium habit, could very well be produced by the\n\ndefendant as his own witness. As far as other witness Collector\n\n(Stamps) is concerned, who was sought to be produced in order to\n\nprove the inquiry report for the inquiry allegedly held by him, it is\n\nseen that said inquiry report is certainly a public document and\n\ncertified copy of which could have been obtained and produced by\n\nthe defendants before the trial court, which was admissible in\n\nevidence. Such application, is believed, and has\n\nrightly been believed to have been filed merely with a view to cause\n\ndelay in the trial. Such application cannot be said to be a bonafide.\n\nTherefore, the learned trial court cannot said to have committed any\n\nerror in rejecting the said application with cost.\n\n\n\n8.
