                  appearing on behalf of respondent nos.1 to<\/p>\n
                  5   and   also    learned     counsel      appearing    on<\/p>\n
                  behalf      of         respondent     no.6\/Accountant<\/p>\n
                  General.\n<\/p>\n
                             The    petitioner,       who   retired      with<\/p>\n
                  effect from 1.9.2003 from the post of Mines<\/p>\n
                  Inspector        and    functioning       as    Assistant<\/p>\n
                  Mining     Officer,        Gaya,    has     prayed      for<\/p>\n
                  directing the respondents to make payment<\/p>\n
                  of monetary benefit of 2nd A.C.P., which<\/p>\n
                  was granted vide Annexure-1 to the petition<\/p>\n
                  i.e.    Memo     No.180    dated    2.2.2010.       Learned<\/p>\n
                  counsel     for    the    petitioner      submits      that
\n                      2<\/span><\/p>\n
petitioner had earlier filed representation<\/p>\n
and    the     Assistant          Director,        Mines        and<\/p>\n
Mining Department, Gaya vide Annexure-4 to<\/p>\n
the    writ      petition,            has    requested          the<\/p>\n
Director,      Mines       and        Minerals     Department,<\/p>\n
Government of Bihar, Patna for sending his<\/p>\n
Service Book. However, on one plea or the<\/p>\n
other, actual benefit has not been given to<\/p>\n
the petitioner.\n<\/p>\n
             The writ petition is being disposed<\/p>\n
of granting liberty to the petitioner to<\/p>\n
file     a      fresh           representation               before<\/p>\n
respondent nos.3 and 5 enclosing therewith<\/p>\n
photo copy of Service Book within a period<\/p>\n
of     six     weeks           from      today.        If     such<\/p>\n
representation             is         filed,       both        the<\/p>\n
respondents i.e. respondent nos.3 and 5 are<\/p>\n
directed       to    examine          the   same       and    pass<\/p>\n
appropriate order redressing the grievance<\/p>\n
of the petitioner within a period of two<\/p>\n
months    from       the       date    of   filing      of    such<\/p>\n
representation. If the respondents consider<\/p>\n
the    claim    of       the    petitioner        as    genuine,<\/p>\n
they are required to issue sanction order<\/p>\n
within two months from the date of filing<\/p>\n
of such representation. It is expected that
\n                         3<\/span><\/p>\n
        after receipt of the sanction order, the<\/p>\n
        respondent     no.6\/Accountant    General    will<\/p>\n
        issue authorization within one month from<\/p>\n
        the date of receipt of sanction from the<\/p>\n
        State Government.\n<\/p>\n
                With     aforesaid     observation    and<\/p>\n
        direction, the petition stands disposed of.<\/p>\n
