SINGH &amp; ORS.\n\nDATE OF JUDGMENT:\t30\/11\/2000\n\nBENCH:\nS R Babu,, S N Variava\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>L&#8230;..I&#8230;&#8230;&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>      J U D G M E N T<\/p>\n<p>      RAJENDRA BABU, J.\t :\n<\/p>\n<p>      This  appeal  is filed against the orders made by\t the<br \/>\nHigh  Court  either  by the learned Single Judge or  by\t the<br \/>\nDivision  Bench\t of  the  High Court on\t an  appeal  thereto<br \/>\ndeclining  to interfere with an adjudication by the Tribunal<br \/>\nunder  the Industrial Employment (Standing Orders) Act, 1946<br \/>\n[hereinafter referred to as the Act] either by the learned<br \/>\nSingle\tJudge or by the Division Bench of the High Court  on<br \/>\nan appeal thereto.  Section 13-A of the Act provides that if<br \/>\nany  question arises as to the application or interpretation<br \/>\nof a standing order any employer or workman or a trade union<br \/>\nor  other  representative  body\t of workmen  may  refer\t the<br \/>\nquestion  to  any  one of the Labour Courts and\t the  Labour<br \/>\nCourt to which such question is referred shall, after giving<br \/>\nopportunity  to the parties, decide the same, which shall be<br \/>\nfinal  and binding on the parties.  Standing Order 15(x)  of<br \/>\nthe  Certified\tStanding  Order\t of 1953  of  the  appellant<br \/>\nprovides  that taking intoxicants or noxious drugs while  on<br \/>\nduty or being under their influence when reporting for duty,<br \/>\nwould  amount to misconduct entailing dismissal and Standing<br \/>\nOrder  15(b)  provides\tthat  no   order  of  dismissal\t  or<br \/>\nsuspension  for more than a week or of stoppage of increment<br \/>\nshall  be made until an enquiry has been held to investigate<br \/>\nthe  circumstances of the case and to decide what offence or<br \/>\noffences were committed.  The accused workman shall have the<br \/>\nright  to  be  present\tat the enquiry and  to\tproduce\t any<br \/>\nwitness\t in his defence.  Detailed and elaborate  provisions<br \/>\nhave  been made as to composition of the enquiry  committee,<br \/>\nreport\tto  be\tmade and action to be  taken  thereon.\t One<br \/>\nSushil\tKumar  Mukherjee  had been  dismissed  invoking\t the<br \/>\naforesaid  provisions without holding an enquiry.   However,<br \/>\nthat  matter  became final as the Labour Court and the\tHigh<br \/>\nCourt\tdismissed   the\t order\t made  therein.\t  In   those<br \/>\ncircumstances,\tan application was filed before the Tribunal<br \/>\nunder  the Act seeking interpretation as to the true  effect<br \/>\nof  these provisions.  The contention put forth on behalf of<br \/>\nthe  appellant\tis  that  there is  no\tpresent\t dispute  or<br \/>\ncontroversy between the parties and that what led respondent<br \/>\nNo.1  to file his application is an apprehension in his mind<br \/>\nthat unless there is a proper interpretation of clause 15 of<br \/>\nthe  Certified\tStanding  Order of 1953, the  management  is<br \/>\nlikely to victimise the workmen.  The Tribunal rejected this<br \/>\ncontention.   The  High Court held that the apprehension  of<br \/>\nthe  applicant-respondent No.1 cannot be stated to be as one<br \/>\npurely\t imaginary  not\t based\ton   facts  and\t merely\t  an<br \/>\napprehension  in his mind.  His claim for interpretation  of<br \/>\nclause\t15  is\tthat  there was action\ttaken  invoking\t the<br \/>\nprovisions  of clause 15 of the Certified Standing Order  of<br \/>\n1953 in a particular manner, correctness of which was put in<br \/>\nissue  for  interpretation and that such a matter cannot  be<br \/>\nstated\tto  be one not covered by Section 13-A of  the\tAct.<br \/>\nThe  view taken by the High Court, therefore, does not\tcall<br \/>\nfor  any interference.\tThe appeal is, therefore, dismissed.<br \/>\nNo costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Calcutta Electric Supply Corpn. &#8230; vs Shew Kr.
