Electricity<\/p>\n<p>connection was provided to the petitioner&#8217;s industrial unit in the<\/p>\n<p>year 2005 with a connected load of 18 KW. Shortly after the<\/p>\n<p>electricity connection was provided, the petitioner applied for<\/p>\n<p>additional connected load. The said request was pending for quite<\/p>\n<p>some time.     While matters stood thus an inspection of the<\/p>\n<p>premises was conducted on 25.2.2009 by the Anti Power Theft<\/p>\n<p>Squad of the Electricity Board.        They prepared Ext.P7 site<\/p>\n<p>mahazar which disclosed that the petitioner was using energy in<\/p>\n<p>excess of the connected load by installing additional machinery.<\/p>\n<p>Ext.P8 provisional assessment order was thereupon passed calling<\/p>\n<p>upon the petitioner to show cause why the sum of Rs.2,54,848\/-<\/p>\n<p>should not be demanded as electricity charges.        The petitioner<\/p>\n<p>submitted his reply. In the meanwhile, on the application<\/p>\n<p>submitted by the petitioner for additional connected load he was<\/p>\n<p>informed that he should pay the cost of installation of one 100<\/p>\n<p>W.P(C).No.33851 of 2010<br \/>\n<span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>KVA transformer. By Ext.P14 order passed on 26.10.2010 the<\/p>\n<p>Assistant   Executive   Engineer    confirmed    the   provisional<\/p>\n<p>assessment.   He also directed the petitioner to regularise the<\/p>\n<p>unauthorised additional load in terms of paragraph 51(5) of the<\/p>\n<p>Kerala State Electricity Board Terms and Conditions of Supply,<\/p>\n<p>2005. Ext.P14 is under challenge in this writ petition wherein the<\/p>\n<p>petitioner seeks a direction to the respondents to permit him to<\/p>\n<p>avail the power supply as at present upto 31.12.2010.<\/p>\n<p>      2. The petitioner does not dispute the fact that he had<\/p>\n<p>used energy in excess of the connected load without the sanction<\/p>\n<p>of the Board. The petitioner does not dispute the assessment of<\/p>\n<p>energy charges made by the respondent in Ext.P8 provisional<\/p>\n<p>order.   The only request made by the petitioner before the<\/p>\n<p>Assistant Executive Engineer was that he should be given time<\/p>\n<p>upto 31.12.2010 to continue the existing arrangement and that<\/p>\n<p>as the industry is to be shifted to another place it would be<\/p>\n<p>uneconomical to pay for a transformer. By the impugned order<\/p>\n<p>the Assistant Executive Engineer granted the petitioner 15 days&#8217;<\/p>\n<p>time to regularise the unauthorised additional load in terms of<\/p>\n<p>W.P(C).No.33851 of 2010<br \/>\n<span class=\"hidden_text\">                                   -:3:-<\/span><\/p>\n<p>paragraph 51(5) of the Kerala State Electricity Board Terms and<\/p>\n<p>Conditions of Supply, 2005. In my opinion on the admitted facts<\/p>\n<p>the stand taken by the respondents cannot be said to be illegal.<\/p>\n<p>Under section 46 of the Act read with regulation 4 of the Kerala<\/p>\n<p>State     Electricity   Regulatory     Commission     (Accounting)<\/p>\n<p>Regulations, 2005, framed by the Kerala State Electricity<\/p>\n<p>Regulatory Commission the petitioner is bound to meet the<\/p>\n<p>expenses for installing a transformer in order to give him<\/p>\n<p>additional power.    Under regulation 51(5) of the Kerala State<\/p>\n<p>Electricity Board Terms and Conditions of Supply, 2005 Low<\/p>\n<p>Tension consumers who have exceeded the connected load are<\/p>\n<p>bound to take steps to regularise the unauthorised additional<\/p>\n<p>load failing which the Board is entitled to disconnect the supply.<\/p>\n<p>In such circumstances as the petitioner had only sought time till<\/p>\n<p>31.12.2010 to shift to another premises and to permit him to<\/p>\n<p>continue to use the existing power supply till such time, the writ<\/p>\n<p>petition has become infructuous.
