THAKKER\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>(Arising out of SLP(CRL)No.3708-3710\/2003)<\/p>\n<p>ARIJIT PASAYAT, J.\n<\/p>\n<p>\t\tLeave granted.\n<\/p>\n<p>\t\tThe State of Orissa questions legality of the judgment<br \/>\nrendered by a learned Single Judge of the Orissa High Court disposing<br \/>\nof three petitions filed under Section 482 of the Code of Criminal<br \/>\nProcedure, 1973 ( in short the &#8216;Code&#8217;).  The petitions were filed,<br \/>\ninter alia, &#8211; (1) to quash the charge sheet filed by the Investigating<br \/>\nOfficer (Vigilance Cell) Bhubaneshwar, (2) to quash the order dated<br \/>\n9.12.2002 taking cognizance of offences punishable under Section 468,<br \/>\n471 and 420 of the Indian Penal Code, 1860 ( in short the &#8216;IPC&#8217;); and<br \/>\n(3) to quash the order passed rejecting the prayer in terms of Section<br \/>\n205 of the Code and rejecting the prayer to recall the order directing<br \/>\nissuance of non-bailable warrant of arrest.  It is to be noted that<br \/>\nVigilance G.R. Case No. 17 of 2001 was at the relevant point of time<br \/>\npending in the Court of Special C.J.M. (Vigilance), Bhubaneswar.  The<br \/>\nstarting point of litigation was drawing up of first information report<br \/>\non 29.5.2001 by the Inspector of Police, Vigilance Cell, Unit Office,<br \/>\nBhubaneswar.  Though several government officials were charged for<br \/>\ncommission of offences under the IPC and the Prevention of Corruption<br \/>\nAct, 1988 ( in short &#8216;the PC Act&#8217;), according to the accused the<br \/>\ninvestigating officer did not find sufficient evidence to bring home<br \/>\ncharge of complicity of the government officials and charge-sheet was<br \/>\nfiled only so far as the present  accused  respondent is concerned.<br \/>\nAs cognizance was taken and the prayer to dispense with personal<br \/>\nappearance and recall of the non-bailable warrant of arrest issued were<br \/>\nrejected petitions were filed under Section 482 of the Code before the<br \/>\nHigh Court.  A separate petition under Section 482 of the Code was<br \/>\nfiled taking the stand that the concerned investigating officer had no<br \/>\njurisdiction to investigate the matter and, therefore, the proceedings<br \/>\nbefore the trial court were vitiated being without jurisdiction.  The<br \/>\nHigh Court considered the last described petition as the pivotal one<br \/>\nand took others to be consequential.  By the impugned judgment the High<br \/>\nCourt held that investigation was unauthorized and, therefore, the<br \/>\nproceedings were vitiated.  Reliance was placed on a decision of the<br \/>\nPatna High Court in J..A.C. Saladanha  v.  Inspector General of Police,<br \/>\nBihar, Patna and Ors.  ( 1979 ILR (Patna) 459 ).  Accordingly,<br \/>\nproceedings were quashed.  High Court did not think it necessary to<br \/>\ndeal with the other petitions separately.\n<\/p>\n<p>\tIn support of the Appeal learned counsel for the State submitted<br \/>\nthat the High Court&#8217;s approach was clearly erroneous.  Reliance on the<br \/>\ndecision of the Patna High Court, referred above, was really of no<br \/>\nconsequence as the judgment in question has been set aside by this<br \/>\nCourt in <a href=\"\/doc\/1727525\/\">State of Bihar and Another  vs.  J.A.C. Saldanha and Ors.<\/a> etc.<br \/>\n[(1980) 1 SCC 554 ].\n<\/p>\n<p>\tLearned counsel for the appellant-State further submitted that<br \/>\nthe decision of the Patna High Court, on which the reliance was placed<br \/>\nhas been set aside by this Court as noted above and unfortunately<br \/>\neffect of the judgment by this Court had not been considered by the<br \/>\nHigh Court.\n<\/p>\n<p>\tPer contra, learned counsel appearing for the respondent<br \/>\nsubmitted that the whole case was outcome of political conspiracy and<br \/>\nmala fides.  If the government officials were not proceeded with, it is<br \/>\nstrange that the respondent alone was picked up and accusations were<br \/>\nmade against him alleging commission of various offences.  Therefore,<br \/>\nit was submitted that the High Court&#8217;s order does not need any<br \/>\ninterference.\n<\/p>\n<p>\tIt is strange that a decision which has been overruled by this<br \/>\nCourt nearly quarter of a century back was cited by the Bar and the<br \/>\ncourt did not take note of this position and disposed of the matter<br \/>\nplacing reliance on the said overruled decision.  It does not appear<br \/>\nthat the decision of this Court reversing the judgment of the High<br \/>\nCourt was brought to the notice of the learned Single Judge who was<br \/>\ndealing the matter.  It is a very unfortunate situation that learned<br \/>\ncounsel for the accused who is supposed to know the decision did not<br \/>\nbring this aspect to the notice of the learned Single Judge.  Members<br \/>\nof the  Bar are officers of the Court.   They have a bounden duty to<br \/>\nassist the Court and not mislead it.  Citing judgment of a Court which<br \/>\nhas been overruled by a larger Bench of the same High Court or this<br \/>\nCourt without disclosing the fact that it has been overruled is a<br \/>\nmatter of serious concern.  It is one thing that the Court notices the<br \/>\njudgment overruling the earlier decision and decides on the<br \/>\napplicability of the later judgment to the facts under consideration on<br \/>\nit.  It also does not appear that learned counsel appearing for the<br \/>\nrespondent before the High Court did not refer to judgment of this<br \/>\nCourt.  All this shows that the matter was dealt with very casually.<br \/>\nFrom the judgment of the High Court it is noticed that the hearing was<br \/>\nconcluded on 13.3.2003 and the judgment was delivered on 25.4.2003.  It<br \/>\nwas certainly the duty of the counsel for the respondent before the<br \/>\nHigh Court to bring to the notice of the Court that the decision relied<br \/>\nupon by the petitioner before the High Court has been overruled by this<br \/>\nCourt.  Moreover, it was duty of the learned counsel appearing for the<br \/>\npetitioner before the High Court not to cite an overruled judgment.  It<br \/>\nis not that the decision is lost in antiquity.  It has been referred to<br \/>\nin a large number of cases since it was rendered.  It has been referred<br \/>\nto recently in many cases e.g. S.M. Datta v. State of Gujarat ( 2001<br \/>\n(7) SCC 659), M.C. Abraham V. State of Maharashtra ( 2003 (2) SCC 649),<br \/>\n<a href=\"\/doc\/767596\/\">Union of India v. Prakash P. Hinduja<\/a> ( 2003 (6) SCC 195) and earlier in<br \/>\nmany oft cited decisions in <a href=\"\/doc\/1033637\/\">State of Haryana v. Bhajan Lal<\/a> ( 1992 Supp.<br \/>\n(1) SCC 335 ), <a href=\"\/doc\/1830927\/\">Janta Dal v. H.S. Chowdhary<\/a> ( 1992 (4) SCC 305), <a href=\"\/doc\/1787029\/\">Union<br \/>\nof India v. W.N. Chadha<\/a> ( 1993 Supp. (4) SCC 260) and <a href=\"\/doc\/343981\/\">State of Bihar v.<br \/>\nP.P. Sharma<\/a> ( 1992 Supp. (1) SCC 222).  We can only express our anguish<br \/>\nat the falling standards of professional conducts.  Impugned judgment<br \/>\nof the High Court is set aside.  We remit the matter back to the High<br \/>\nCourt so that it can deal the petitions afresh and decide on merits<br \/>\ntaking into account the decision and all other relevant aspects of this<br \/>\nCourt.
