Notification under<br \/>\nSection 4 of the Act was published on 29th April, 1994 and<br \/>\ndeclaration under Section 6 of the Act was published on 6th<br \/>\nOctober, 1994. The Special Land Acquisition Officer on completion of<br \/>\nall the legal formalities pronounced the award on 6th<br \/>\nJanuary, 1995.\n<\/p>\n<p>2.1.\t\tThe<br \/>\nrespondents being dissatisfied with the quantum of compensation<br \/>\npreferred an application to the Collector under Section 18 of the Act<br \/>\nfor making Reference to the Court for enhancement of the<br \/>\ncompensation. The learned trial Court by the aforesaid award enhanced<br \/>\nthe compensation with an additional amount of Rs.19.10 per sq.mtr. by<br \/>\njudgment and award dated 30th April, 2005.  The Special<br \/>\nLand Acquisition Officer being aggrieved by the said award of the<br \/>\nlearned trial Court has filed these appeals under Section 54 of the<br \/>\nAct.\n<\/p>\n<p>3.0.\t\tHeard<br \/>\nlearned counsel for the respective parties. The learned trial Judge<br \/>\nwhile passing the impugned award has relied upon the award passed in<br \/>\nL.R. Case No. 715\/1997 whereby the learned trial Court had awarded<br \/>\ncompensation at Rs.1780\/- The said fact is established from the<br \/>\ndocument  produced at Exh. 14. Apart from that the lands in questions<br \/>\nin the present case and the lands acquired in earlier L.A.R. No.<br \/>\n715\/1997 are adjacent to each other. Thus, the learned trial Court<br \/>\nwas justified in enhancing the impugned award.\n<\/p>\n<p>4.0\t\tIn<br \/>\nview of the above, the impugned award passed by the learned trial<br \/>\nCourt is just and proper and no interference is called for by this<br \/>\nCourt. The appeals are therefore, dismissed.
