Raj Kishore Mandal, son of Arjun Mandal\n                                                                      Petitioners\n                                         Versus\n          THE STATE OF BIHAR                                              OP\n                            -----------\n<\/pre>\n<p>2\/-   28.10.2010             Heard learned Counsel for the petitioners and the<\/p>\n<p>                    State.\n<\/p>\n<p>                             The petitioners seek bail in a case instituted for<\/p>\n<p>                    the offence under sections 302 and 201\/34 of the Indian<\/p>\n<p>                    Penal Code.\n<\/p>\n<p>                             Considering that the entire case is based on<\/p>\n<p>                    suspicion, let the petitioners above named, who are in<\/p>\n<p>                    custody since 26.05.2010, be released on bail on furnishing<\/p>\n<p>                    bail bond of Rs.5,000\/- (Five thousand) with two sureties<\/p>\n<p>                    of the like amount each or any other surety to be fixed by<\/p>\n<p>                    the court concerned to the satisfaction of learned Chief<\/p>\n<p>                    Judicial Magistrate, Purnea in Barhara P.S. Case No. 59 of<\/p>\n<p>                    2010, subject to the conditions, (i) That one of the bailor<\/p>\n<p>                    will be a close relative of the petitioners who will give an<\/p>\n<p>                    affidavit giving genealogy as to how he is related with the<\/p>\n<p>                    petitioners.   The   bailor   will   undertake   to   furnish<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>            information to the Court about any change in address of<\/p>\n<p>            the petitioners. (ii) That the affidavit shall clearly state that<\/p>\n<p>            the petitioners are not an accused in any other case and if<\/p>\n<p>            they are they shall not be released on bail, (iii) That the<\/p>\n<p>            bailor shall also state on affidavit that he will inform the<\/p>\n<p>            court concerned if the petitioners are implicated in any<\/p>\n<p>            other case of similar nature after their release in the present<\/p>\n<p>            case and thereafter the court below will be at liberty to<\/p>\n<p>            initiate the proceeding for cancellation of bail on ground of<\/p>\n<p>            misuse, (iv) That the petitioners will give an undertaking<\/p>\n<p>            that they will receive the police papers on the given date<\/p>\n<p>            and be present on date fixed for charge and if they fail to<\/p>\n<p>            do so on two given dates and delay the trial in any manner,<\/p>\n<p>            their bail will be liable to be cancelled for reasons of<\/p>\n<p>            misuse, and (v) That the petitioners will be well<\/p>\n<p>            represented on each date if they fail to do so on two<\/p>\n<p>            consecutive dates, their bail will be liable to be cancelled.<\/p>\n<p>                                                     ( Anjana Prakash, J. )<\/p>\n<p>Ashwini\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Arjun Mandal &amp;Amp; Anr vs The State Of Bihar on 28 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
