This Court on 24th April,<br \/>\n1995 passed the following order:\n<\/p>\n<blockquote><p>     &#8220;Issue Notice.  Limited to\t the question<br \/>\n     as to  why\t the  proviso  to  Rule\t 1802<br \/>\n     should not be applied to the petitioner,<br \/>\n     namely, Gyan  Chand while\tis continuing<br \/>\n     in officiating  Group &#8216;B&#8217;\tpost, if  the<br \/>\n     authority intends\tto  take  action  for<br \/>\n     retiring the officer in public interest,<br \/>\n     he would  be entitled to be informed and<br \/>\n     if opted for reverted to the substantive<br \/>\n     Group &#8216;C&#8217;\tpost. In  this case, the said<br \/>\n     action has\t not been done. Therefore the<br \/>\n     respondents are at liberty to show cause<br \/>\n     why the proviso should not be applied to<br \/>\n     the petitioner and direction be given to<br \/>\n     make the order in terms thereof.&#8221;<\/p><\/blockquote>\n<p>     Pursuant thereto,\tthe counter-affidavit has been filed<br \/>\nby the\trespondents. Therein,  the Rule\t has been  extracted<br \/>\nwhich states thus:\n<\/p>\n<blockquote><p>     &#8220;Notwithstanding anything\tcontained  in<br \/>\n     this  Rule,   the\tappointing  authority<br \/>\n     shall, if\tit is  of the opinion that it<br \/>\n     is in the public interest to do so, have<br \/>\n     the absolute right to retire any railway<br \/>\n     servant by giving him notice of not less<br \/>\n     than 3 months in writing or 3 months pay<br \/>\n     and allowances  in lieu  of such notice-\n<\/p><\/blockquote>\n<blockquote><p>     (i) if  he is  in Group  &#8216;A&#8217; service  or<br \/>\n     post or  in a  Group &#8216;C&#8217; service or post<br \/>\n     in\t  a    substantive    capacity\t  but<br \/>\n     officiating in  a Group &#8216;A&#8217; or Group &#8216;B&#8217;<br \/>\n     service  or   post\t  and\thad   entered<br \/>\n     Government service\t before attaining the<br \/>\n     age of  thirty five  years, after he has<br \/>\n     attained the age of fifty years. (ii) in<br \/>\n     any other\tcase, after  he has  attained<br \/>\n     the age  of fifty\tfive years:  Provided<br \/>\n     that a  railway servant  who is in Group<br \/>\n     &#8216;C&#8217; post  or service  in  a  substantive<br \/>\n     capacity, but  is holding a Group &#8216;A&#8217; or<br \/>\n     &#8216;B&#8217; post  or service  in an  officiating<br \/>\n     capacity shall, in case it is decided to<br \/>\n     retire him\t from the  Group &#8216;A&#8217; or Group<br \/>\n     &#8216;B&#8217;  post\t of  service  in  the  public<br \/>\n     interest, be  allowed on  his request in<br \/>\n     writing, to  continue in  service in the<br \/>\n     Group &#8216;C&#8217; post or service which he holds<br \/>\n     in a substantive capacity.&#8221;<\/p><\/blockquote>\n<p>     It is  not in  dispute that  on promotion\tto Group &#8216;B&#8217;<br \/>\nservice of  Mechanical Department  the\tappellant  continued<br \/>\ntill 3rd  March, 1985  and thereafter  in senior  scale from<br \/>\nmarch 4,  1985 to  July 3,  1989. It  is contended  for\t the<br \/>\nappellant  that\t in  view  of  the  admitted  fact  that  no<br \/>\nconfirmation  of   probation  was  made\t till  date  of\t his<br \/>\ncompulsory retirement, he must be deemed to be continuing on<br \/>\nprobation and  that, therefore he is entitled to the benefit<br \/>\nof the\tproviso. We  find it difficult to give acceptance to<br \/>\nthe contention.\n<\/p>\n<p>     The proviso  clearly indicates  that a  railway servant<br \/>\nwho is\tin Group  &#8216;C&#8217;  post  or\t service  in  a\t substantive<br \/>\ncapacity, but  is holding  a Group &#8216;A&#8217; or &#8216;B&#8217;service of post<br \/>\nin an  officiating capacity,  shall in\tcase  of  compulsory<br \/>\nretirement, be allowed on his request in writing to continue<br \/>\nin  Group   &#8216;C&#8217;\t post  or  service,  which  he\tholds  in  a<br \/>\nsubstantive capacity.  It is  seen that\t in view of the fact<br \/>\nthat the  appellant continued  in Group &#8216;B&#8217; post not only in<br \/>\nordinary scale\tbut also in senior scale of pay till July 3,<br \/>\n1989, for  10 years to the date on which he was compulsorily<br \/>\nretired, it  could not\tbe said\t that he  continued only  on<br \/>\nofficiating basis  for 10 years. It would be obvious that he<br \/>\ncontinued in  substantive capacity  as Group &#8216;B&#8217; officer. He<br \/>\ncould not simultaneously continued in Group &#8216;C&#8217; service in a<br \/>\nsubstantive  capacity.\t Therefore,  the   proviso  has\t  no<br \/>\napplication to the facts of this case.\n<\/p>\n<p>     Under these  circumstances, it  cannot be said that the<br \/>\norder of  retirement made  in respect  of the  appellant  is<br \/>\nvitiated by any error of law warranting our interference.\n<\/p>\n<p>     The appeal is accordingly dismissed.
