RY DHIVARE for Applicant(s) : 1, \nPUBLIC\nPROSECUTOR for Respondent(s) : 1, \nMR HARDIK A DAVE for\nRespondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tCounsel<br \/>\nappearing for both sides jointly submitted that the disputes have<br \/>\nbeen resolved between the parties and cheque amounts have been paid<br \/>\nover by the  petitioners.\n<\/p>\n<p>\tIn<br \/>\nthe present group of petitions, original accused has challenged the<br \/>\njudgments of the courts below by which he has been convicted and<br \/>\nsentenced for imprisonment for one year  for dishonour of cheques.<br \/>\nIt is stated that total amount involved  is about Rs.3,50,000\/- in<br \/>\nall the Revision Applications.\n<\/p>\n<p>\tIn<br \/>\nview of the settlement between the parties  and payment of cheque<br \/>\namounts, conviction is required to be set aside.  However, in view of<br \/>\nthe  decision of the Apex Court  in the case of Damodar S. Prabhu<br \/>\nv. Sayed Babalal H., (2010) 5<br \/>\nSCC 663,  the petitioner shall have to  pay  costs which can go upto<br \/>\n15% of the cheque amount and in the present cases, the cost is<br \/>\nquantified  at Rs.35,000\/- (Rupees thirtyfive thousand only) which<br \/>\nshall  be deposited before the Gujarat State Legal Services Authority<br \/>\nlatest by 30th<br \/>\nOctober, 2010.
