Patil.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>D.P.MOHAPATRA, J.\n<\/p>\n<p>Leave granted.\n<\/p>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>    The\t controversy  raised in this appeal relates  to\t the<br \/>\nquestion  whether  certain part-time sweepers serving  under<br \/>\nthe  Bank  of  Rajasthan   Limited,  appellant\therein,\t are<br \/>\nentitled  to scale of wages or only fixed wages .   From<br \/>\nthe materials available on record it is clear that according<br \/>\nto  the settlement arrived at between the management of\t the<br \/>\nBank  and the Union representing the workmen those part-time<br \/>\nsweepers  who were working for more than six hours in a week<br \/>\nwere  entitled\tto the benefit of scale of wages  and  the<br \/>\nsweepers rendering service for less than six hours in a week<br \/>\nwere to receive fixed wages.\n<\/p>\n<p>    On a dispute raised by the General Secretary of the Bank<br \/>\nWorkers\t Union\t Respondent No.4, the  Central\tGovernment<br \/>\nreferred  the  following dispute to the Industrial  Tribunal<br \/>\nfor adjudication :\n<\/p>\n<p>    Whether  the action of Zonal Manager, Bank of Rajasthan<br \/>\nLimited,  Zonal Office, New Delhi, in not giving the  salary<br \/>\nto  all\t the  nine  employees named  below,  employed  in  8<br \/>\ndifferent  branches  of\t the bank as part time\tsweepers  is<br \/>\nlegal  and  valid ?  If not, to what relief the workmen\t are<br \/>\nentitled to ?\n<\/p>\n<blockquote><p>    1.Smt.Khajani Devi\t\t2. Smt.Ramo Devi\n<\/p><\/blockquote>\n<blockquote><p>    3.\tSmt.Saroj\t\t4. Smt.\t Dhanpati\n<\/p><\/blockquote>\n<blockquote><p>    5.\tSh.Jai Bhagwan\t\t6.Smt.Kamlesh Devi\n<\/p><\/blockquote>\n<blockquote><p>    7.Smt.Vinod\t\t\t8 Smt. Sumitra Devi.<\/p><\/blockquote>\n<p>    9. Smt. Chander Kala<\/p>\n<p>    The\t  Industrial   Tribunal\t disposed   of\t the   case,<br \/>\nI.D.No.38\/91  by the Award dated 26th December, 1994, on the@@<br \/>\n\t\t     JJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nfollowing terms :@@<br \/>\nJJJJJJJJJJJJJJJJJ<\/p>\n<p>    Both  the parties had agreed for inspection of the site<br \/>\nin  order  to ascertain the number of working hour.  On\t the<br \/>\nbasis of the inspection report the Chart Ex.M-1 was filed by<br \/>\nthe  management\t and  the workmen union accepted  the  Chart<br \/>\nEx.M-1\tand  stated that the claim for rest of the money  be<br \/>\ndismissed.   The  Management Representative also  agreed  to<br \/>\nthis.\tIn  view  of this situation it is ordered  that\t the<br \/>\npayment according to the Chart Ex.M-1 be made to the workmen<br \/>\nand, their claim for rest of the amount\/points is dismissed.<br \/>\nParties shall bear their own costs of the dispute.\n<\/p>\n<p>    Feeling  aggrieved by the Award the appellant filed C.W.<br \/>\nNo.2235\/98  and\t C.M.No.3635\/98 before the Delhi High  Court<br \/>\nwhich  were  disposed  of by the single Judge by  the  Order<br \/>\ndated  2.9.1999,  confirming the Award with  a\tmodification<br \/>\nregarding  the award of interest.  The operative portion  of<br \/>\nthe Order reads:\n<\/p>\n<p>    In\tview of the above, the impugned award does not call<br \/>\nfor any interference\/judicial review as far as merits of the<br \/>\naward  is concerned under Article 226 of the Constitution of<br \/>\nIndia except to the extent of the grant of 12% interest.  In<br \/>\nview  of the above, the impugned award is set aside\/modified<br \/>\nto  the\t extent of the grant of 12% interest.  Rest  of\t the<br \/>\naward does not call for any judicial review.  The petitioner<br \/>\nshall  comply with the modified award as above within  eight<br \/>\nweeks from today.&#8221;\n<\/p>\n<p>    Against the said order of the single Judge the appellant<br \/>\nfiled  an  appeal, L.P.A.No.483\/1999 which was dismissed  by@@<br \/>\n\t   JJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nthe  Division  Bench  by   Judgement\/Order  dated  4.11.1999@@<br \/>\nJJJJJJJJJJJJJJJJJJJJ<br \/>\nholding\t inter\talia that from the papers on record  it\t was<br \/>\nclear  that  the respondents were putting in work  for\tmore<br \/>\nthan  one  hour\t per day, and therefore, they  were  rightly<br \/>\ngiven  the  benefit  by the  Central  Government  Industrial<br \/>\nTribunal.   The present appeal filed by the Bank is directed<br \/>\nagainst the said Judgment\/Order.\n<\/p>\n<p>    In\tthe  Order dated 9.5.2000 this Court  while  issuing<br \/>\nnotice\tconfined the question to be examined to whether the@@<br \/>\n\tJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nTribunal  was justified in awarding back wages in favour  of@@<br \/>\nJJJJJJJJJJJJJ<br \/>\nthe  workmen  Mrs.  Dhanpati Devi and Jai Bhagwan  from\t the<br \/>\ndate of their respective appointments.\n<\/p>\n<p>    It\twas  not  disputed before us  that  the\t controversy<br \/>\nraised\tin  the present proceeding is confined only  to\t the<br \/>\naforementioned\ttwo  workmen.  The question is whether\tthey<br \/>\nare  entitled  to  back wages from the respective  dates  of<br \/>\ntheir  appointments or from any other subsequent date.\tFrom<br \/>\nthe facts noted in the preceding paragraphs it is clear that<br \/>\nthe dispute regarding the claim of scale wages was decided<br \/>\nby  the\t Industrial  Tribunal by the Award  passed  on\t26th<br \/>\nDecember,  1994.   The Award was passed on determination  of<br \/>\nthe  question  whether these workmen were rendering  service<br \/>\nfor  more than six hours in a week.  On the materials placed<br \/>\nbefore\tit the Tribunal accepted the case of the Union\tthat<br \/>\nthe workmen concerned were infact rendering service for more<br \/>\nthan  six  hours  a  week  and\trejected  the  case  of\t the<br \/>\nmanagement to the contrary.\n<\/p>\n<p>    In\tthe facts and circumstances of the case discussed in<br \/>\nthe preceding paragraphs it is our view that the calculation<br \/>\nof the back wages on the basis of the entitlement as held in<br \/>\nthe  award  should be made from the date of the\t award\ti.e.<br \/>\n26th  December,\t 1994.\t The  Award passed  by\tthe  Central<br \/>\nGovernment  Industrial\tTribunal  as confirmed by  the\tHigh<br \/>\nCourt  stands  modified to this extent only.
