Having regard to the facts and circumstances of the case, the<br \/>\napplication is taken up for hearing today.\n<\/p>\n<p>2.\tThe<br \/>\napplicant needs temporary bail for 21 days on the ground of<br \/>\nengagement ceremony of his daughter. Considering the fact that out of<br \/>\n7 years&#8217; sentence which is imposed on the applicant under Sections<br \/>\n363, 366 and 306 of the IPC, he has already undergone 3 years, 7<br \/>\nmonths and 29 days. He has enjoyed only furlough leave during the<br \/>\nmonth of May, 2010 for 14 days.  Therefore, I am of the view that the<br \/>\napplicant deserves to be enlarged on temporary bail.\n<\/p>\n<p>3.\tIn<br \/>\nview of the aforesaid facts and circumstances, the application is<br \/>\npartly allowed and the applicant is<br \/>\nordered to be released on temporary bail for a period of 10 (Ten)<br \/>\ndays from his release upon furnishing a personal bond of Rs.5,000\/-<br \/>\n(Rupees five thousand only) before the concerned Superintendent,<br \/>\nSabarmati Central Jail and on the conditions that:-\n<\/p>\n<p>[a]\the<br \/>\nshall surrender before the jail authorities upon completion of the<br \/>\naforesaid period.\n<\/p>\n<p>[b]\the<br \/>\nshall not leave the State of Gujarat.\n<\/p>\n<p>4.\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>(Z.K.SAIYED,<br \/>\nJ.)<\/p>\n<p>ynvyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Mohd.Imtiyaj vs State on 15 December, 2010 Author: Z.K.Saiyed,&amp;Nbsp;
